Q <br />C. Provide excerpts of the minutes from the OUTBoard relating to discussion on the <br />regulation of drive - thru's. <br />The Board adjourned the public hearing to October 6, 2009 in order to allow staff to compile and <br />present the requested information. Please refer to: <br />• Attachment Five (5) of this packet for the study material provided to the Planning Board <br />at its April 1, 2009 regular meeting. It should be noted that this material was not intended <br />to be an exhaustive search for drive -thru or idling issues but examples of the pro's and <br />con's associated with regulating such activities, <br />• Attachment Six (6) for a breakdown on the regulation of drive -thru facilities by other <br />communities, and <br />• Attachment Seven (7) for the minutes from the various OUTBoard meetings where the <br />regulation of drive -thru facilities were discussed. <br />In reviewing this information staff would like to make the following observations: <br />1. - Most communities do not ban drive - thru's outright but instead limit where such facilities <br />are permitted. As a reminder, Orange County currently prohibits drive -thru facilities <br />within the Hillsborough Economic Development District and the Efland Cheeks Overlay <br />District. <br />2. It appears that states, and in some cases local governments, tend to attempt to regulate <br />motor idling by restricting idling time rather that regulating speck land uses (i.e. drive - <br />thru's). Enforcement, however, could be a major issue. It should be noted that some of <br />these same programs appear to focus on education /outreach while also incorporating <br />some form on enforcement component (i.e. fines). <br />3. Staff still recommends the adoption of Option Two (2) as detailed within Attachment One <br />(1) of this document. Option Two (2) supports the sustainability approach of balancing <br />the environmental, economic, business support, and equity in access to service(s) while <br />preserving quality site planning attributes (please refer to Attachment Ten (10)). <br />4. Staff supports the Planning Board recommendation on the implementation of a <br />countywide awareness educational campaign about the potential dangers of allowing <br />vehicles to idle. <br />PLANNING BOARD REVIEW: As a reminder, the Planning Board voted seven (7) to two (2) to <br />recommend the following: <br />1. The Board of County Commissioners initiate a comprehensive and countywide <br />awareness education program about idling and the contaminants it puts in our air, <br />focusing specifically on areas with children and idling vehicles (such as schools, ball <br />fields, etc.) to start in the fall of 2009 and end in the spring of 2011. The goal of the <br />program is to encourage individuals to turn off their vehicles when parked rather than <br />allowing them to idle, and <br />2. To recommend the Board of County Commissioners disregard staffs two (2) options and <br />take no action on adopting regulations banning development of drive -thru facilities within <br />the County's planning jurisdiction (Option 1) or adopting comprehensive development <br />standards for drive -thru facilities (Option 2). <br />
