.... -, <br />~_~+ <br />Mr. Freeman stated that the plan of the grading contractor <br />calls for a dam three feet above.the surface on which they are <br />working at all times. <br />Commissioner Pinney moved that the County find Brendles in <br />non-compliance and to assess a c.ivil.penalty_of $100.00 a day <br />until such time as they are in compliance, and that the County <br />Attorney be authorized to seek injunctive relief against Brendles. <br />The County Attorney reminded the Board that he had suggested <br />that before fines are assessed in such cases, that notice be given <br />to the proper parties, and that they be given an opportunity to <br />appear before the Board with an appeal. He added this would not <br />affect the Board's decision to seek injunctive relief. <br />The Chairman declared Commissioner Pinney's motion died far <br />lack of a second. <br />Commissioner Gustaveson stated he felt a hand delivered letter <br />should be sent to Mr. Britt indicating that the Beard would <br />consider a second civil penalty effective May 1, 1978 if the project <br />is not brought into compliance and to wait on the injunctive relief. <br />Commissioner Pinney moved, seconded by Commissioner Willhoit, <br />to authorize the County Attorney to seek injunctive relief against <br />Son-Shine Grading Ca. for their violation of the Erosion Control <br />Ordinance. <br />All members of the Board voted aye on this motion, except <br />Mr. Gustaveson who voted nay. The motion was declared passed.' <br />Mr. Freeman was requested to advise Mr. Britt that a new <br />second civil penalty would be assessed effective May 1, 1978, <br />and that the first penalty of $2,600 is past due. <br />Commissioner Pinney asked the Clerk to contact Mr.;...Chappel <br />at the Department of Transportation that pipes on State Road 1949 <br />needed cleaning out. <br />Mr. Whitted reminded the Board of a meeting of June 5, 1978 <br />at 7e30 with the burham City Council. Dr. Sim Leutze will make a <br />statement regarding the Durham-Orange Employment and Training <br />service. <br />Item 12: The Manager will file his recommended budget for the <br />1978-1979 fiscal year with the Clerk. <br />The Finance Officer presented to the Clerk to the Board a <br />copy of the 1978-79 budget for public inspection. <br />The meeting was then adjou.~d. <br />. ~' <br />~~ ~ <br />'/Richard Whitted, Chairm~- <br />Agatha Johnson, Clerk <br />
