Commissioner Pinney asked to be excused from voting on this plat as <br /> he is an adjoining property owner. This permission etas granted, <br /> Commissioner Walker moved that the plat of Jean Andrews Earnhardt be <br /> approved with the two requested variances . <br /> ThP Board discussed whose responsibility it is to maintain the pri- <br /> vate road. Commissioner Pinney suggested that in the future, no variances <br /> regarding the road be granted. <br /> Commissioner Whitted seconded the motion of Commissioner Walker. <br /> The Chairman called for a vote on the motion and voting aye were <br /> Commissioners Gustaveson, Whitted, Walker, and Willhoit. The motion <br /> was declared passed. <br /> B. Jesse C. Riley <br /> This plat proposes the division of two acres from a larger tract. The <br /> plat shows a 60 foot private road right of way,however, Mr. Riley is <br /> requesting a variance from the road construction requirement as access is <br /> obtained through another private road. The Planning Board has unanimously <br /> endorsed this request. This land is located in Chapel Hill Township in <br /> the Southern Triangle area off of Farrington Road. <br /> Mr. Kirk informed the Board that the deed to this land states if lots <br /> are developed, the 60 foot private road will be constructed at that time . <br /> Upon motion of Commissioner Pinney, seconded by Commissioner Gustaveson, <br /> it was moved and adopted to approve the plat of Jesse C. Riley with the <br /> requested variance. <br /> Item 14 : Petitions for Rezoning <br /> A. W. D. Jones , Jr. <br /> This property located in Chapel Hill Township, is off Eubanks Road <br /> next to the railroad crossing. Mr. Jones is requesting rezoning of a one <br /> acre tract from residential to rural commercial, with plans to put a stor- <br /> age warehouse on the property, which has railroad tracks and a power line <br /> easement running through the property. <br /> Commissioner Walker moved that the Board accept the Planning Board ' s <br /> recommendation to approve this rezoning request. Commissioner Pinney <br /> seconded the motion. <br /> Commissioner Whitted reminded the Board that some opposition to this <br /> rezoning was expressed at the February Public Hearing. He stated he felt <br /> the area had problems as far as traffic is concerned, and feels spot zoning <br /> such as this would not be in the best interest of the area. <br /> Commissioner Gustaveson stated he felt some criteria was needed to <br /> make sure that this type of development would be appropriate to the area. <br /> He suggested negotiation between the Planning Department and Mr. Jones be <br /> conducted to see if appropriate buffers might be installed to provide pro- <br /> tection to residents as well as the warehouse. <br /> Commissioner Willhoit stated with the railroad and the power line <br /> easements through the property, the use of the property was limited, and <br /> did indicate the need to "get on with the land use plan" . He added that <br /> this might be an appropriate area for mixed development. <br /> Further discussion ensued. Commissioner Gustaveson asked that the <br /> motion be amended to request the Planning Staff to meet with Mr. Jones <br /> and discuss appropriate buffers to make the area compatible for rural/ <br /> commercial use. Commissioner Pinney seconded Commissioner Gustaveson's <br /> amended motion. <br /> The Chairman called for a vote on the amended motion and all members <br /> of the Board voted aye. The motion was declared passed. <br /> B. Irving E. Nunn, Jr. <br /> This request is to rezone one acre of a ten acre tract from residen- <br /> tial to general commercial . The property is located in Chapel Hill Town- <br /> ship off Eubanks Road next to the landfill. Access to the property is <br /> proposed through a 60 foot right of way to run down the property line <br /> from State Road 1727 . A railroad track and two power line easements run <br />
