6.1 Program <br />The Owner shall provide to the OMARnomplete Information <br />[egording the Owners requirements for the Project. <br />6.2,Decisions <br />The Owner shall examine information submitted by the CMAR <br />and shall render decisions thereto promptly. <br />6.3 Insurance <br />The Owner shall furnish the insurance that the Owner has <br />agreed to furnish as specified In Article 8. <br />6.4 Notice of Nonconformities <br />If the Owner observes orotherwise becomes aware of any fault <br />or defect in the Project or nonconformity with the Contract <br />Documents, the Owner shall give prompt written notice thereof <br />to the CMAR. <br />6.5&bPurova8s ' <br />The Owner ohoU fumish required Information and approvals <br />and perform Its responsibilities and activities Ina timely manner <br />to facilitate orderly progress of the Work In cooperation with the <br />CMAR.cunsiotent with this Agreement, and in accordance with <br />the. planning and scheduling requirements and, budgetary <br />restraints of the Project. <br />60,Designer <br />The Owner shall retain Designer whose services, duties and <br />responsibilities shall bedescribed Ina written agreement <br />between the Owner and Designer. The oerviceo, dutiea, and <br />responsibilities of the Designer set out in the agreement <br />between the Owner and Designer shall be compatible and <br />consistent with this Agreement and the Contract Duoumeuts, <br />The Owner shall, in Its agreement with the Designer, mqu|na <br />that the Designer perform Its services in cooperation with the <br />CM8R, consistent with this Agreement and In accordance with <br />the plannnV, scheduling and budgetary requirements of the <br />Project os determined by the Owner. The terms and conditions <br />of the agreement between the Owner and the Designer shall <br />not bochanged or waived without written notice to the CMAR <br />provided nt the rime vf the change orrevision. <br />6.7 Budget <br />20 <br />The Owner shall establish the Project and Construction Budget <br />and approve subsequent revisions deemed acceptable as <br />provided in this Agreement. <br />6.8 Separate Contracts <br />The Owner reserves the right to contract separately with other <br />entities to complete portions of the Work of the Project, o,to <br />deploy Its own. employees to complete portions of the Work. If <br />the Owner contracts separately with any other parties, the <br />Owner shall cause all such o8,anmonts to be compatible and <br />consistent with this Agreement. Each of the agreements shall <br />Include waiver of subrogation as naqu|nsd herein. The CIVIAR <br />ognaoo to cooperate with the Owner and Its separate <br />contractors and coordinate theVYorkof all parties, including the <br />Owner's forces o/ separate contractors. Provided the OM8R <br />has reasonable advance notice of the Identity and duties of <br />separate contractors, the CMAR agrees io include coordination <br />and support of the Owner's separate contractors in the General <br />Conditions costs. Disputes or conflicts between the CMAR.the <br />Owner and any separate contractors shall bn subject hzdispute <br />resolution In accordance with the dispute resolution pmWo|000 <br />in Appendix A. <br />6.9 Cooies of Drawings and Specifications <br />The CMAR shall estimate the reasonable number of copies of <br />interim and final drawingo, specifications and Contract <br />Documents required by the CMAR, and shall obtain such <br />copies from the Designer at the CMAR!e expense. The <br />estimated coot of such copies shall be Included In the <br />Guaranteed Maximum Price. <br />OJO Permits and App vals <br />With the cooperation and assistance of the CMAR and the <br />Contractors ae set forth |n this Agreement, the Owner shall ina <br />timely manner secure, submit and pay for necea�aryappmvois. <br />aaoamon�.assessments, penni�and charges roqu|mdfor the <br />construction, use or occupancy of permanent structures, nrfor <br />permanent changes |n existing facilities. <br />6.11 Requirements <br />The Owner shall describe the funding for the Project to the <br />cMxR and the Designer. <br />6.12 Comm unibation with Contractors <br />The Owner, its representatives and consultants. including <br />Designma, shall. communicate With the Contractors only <br />through the CMAR. <br />
