.- <br />L ~_ <br />Mr. Freeland, developer of the property, stated he would perfer to <br />have access to his property over'the railroad crossing if possible. <br />Commissioner Gustaveson objected to approving the entrance Aver the <br />railroad crossing as being a hazardous entrance. <br />Commissioner Walker moved that the Greenbriar Estates final plat be <br />approved with the existing right of way across the railroad tracks. <br />Commissioner Pinney seconded the motion and further discussion ensued. <br />Tt was pointed out that if an easement did exist for the property owners <br />using the railroad crossing, the County Commissioners could not close the <br />crossing. Chairman [whitted stated he felt if the easement is to continue, <br />the roads leading to the crossing should be improved to meet the County <br />Subdivision Standards. <br />. The Chairman called for a vote on Commissioner [walker's motion that <br />' the plat be approved with the existing right of way across the railroad <br />tracks. <br />y <br />Commissioner Pinney then withdrew his second to P4r. Walker's motion, <br />as he did not clearly understand the motion. <br />The Chairman declared the motion of Mr. Walker died for lack of a <br />second. <br />Commissioner Pinney moved that the plat.be approved with both entrances <br />into the subdivision. This motion died for lack of a second. <br />Commissioner Willhoit returned to the meetin at this point. <br />2t was pointed out by the Planning Staff that.the proposed road through <br />the Whispering Pines Subdivision would be difficult to build due to condi- <br />tions of the land. <br />Commissioner Pinney moved to approve the right of way across the rail- <br />... road tracks. Commissioner Walker seconded the motion. <br />The Chairman called for a vote an the motion and voting aye were Com- <br />missioners Pinney, Walker, and Whitted. Voting nay were Commissioners <br />•Willhoit and Gustaveson. The motion was declared passed. <br />Upon motion of Commissioner Gustaveson, seconded by Commissioner Pinney, <br />it was further moved and adopted to follow the Planning Staff's recommenda- <br />tion that a 50 foot buffer strip be .observed along the stream. <br />Upon motion of Commissioner Pinney, seconded by Commissioner twalker, <br />it was then moved and adopted to require the developer of this property to <br />erect railroad warning signs on each side of the railroad crossing. <br />d) Glen Parrish: This is in reality a minor subdivision of 1.6 acres <br />from a twenty-five acre tract. The property owner is requesting a variance <br />from the sixty foot right of way requirement. The Planning Board recommends <br />the plat indicate a sixty foot right of way in front of Mr. Parrish's pro- <br />. party. <br />Mr. Kirk explained to the Board that the property of Mr. Parrish is <br />located just off the Bethel Church Road in Chapel Hill Township. Mr. <br />Parrish is requesting a 30 foot variance for the private road as he cannot <br />obtain a 60 foot easement. The Health Department and the Erosion Control <br />Officer have approved this property. <br />Upon motion of Commissioner Pinney, seconded by Commissa.oner [walker, <br />it was moved and adopted to approve the preliminary plat of Glen Parrish <br />granting a 30 foot variance right of way, but with the requited 60 foot <br />right of way in front of the Parrish property. <br />e) Timberlyne - Phase IT - This subdivision was considered at the <br />Board's January meeting and referred back to the Chapel Hill Planning Board <br />for additional comment. Their comments are attached and will be reviewed <br />by Mr. Minis. <br />The Acting Planning Director informed ishe Board that Timberlyne was <br />approved several years ago as being developed on septic tanks. It is now <br />being resubmitted as a development on sewer. <br />
