" <br />~% <br />c) Ms. Kathy Parker has resigned from the Orange County Board of <br />Health and Commissioner willhoit recommends Dr. Morris Shiffman be named <br />to replace Ms, Parker on this Board. <br />Commissioner Pinney asked that this item be deferred until the <br />February 21st meeting. <br />Item 7: Thy Manager recommends the Board adopt a Resolution support- <br />ing efforts of Triangle J Council of Governments to secure a 1203 Grant for <br />emergency medical services equipment. <br />For copy of Resolution, see page 500 of this book <br />Upon motion of Commissioner Walker, seconded by Gommissianer Pinney, <br />it was moved and adopted to approve the resolution supporting efforts of <br />Triangle J Council of Governments to secure a 1203 Crant for emergency <br />medical services equipment. <br />Item 8: The Manager recommends the Board accept a proposal for audit <br />of the County's 1977-197$ fiscal year records, submitted by Peat, Marwick, <br />and Mitchell. <br />The agenda attachment stated that Peat, Marwich, and Mitchell has sub- <br />mitted a proposal to audit all Orange County Funds for the 1977-78 fiscal <br />year for the sum of $19,000. Their contract for the fiscal year just com- <br />pleted required essentially the same service and was performed for $18,000. <br />Upon motion of Commissioner Pinney, seconded by Commissioner Gustaveson, <br />it was moved and adopted to approve the proposal for audit of County 1977- <br />. 1978 fiscal year records as submitted by Peat, Marwick, and Mitchell at a <br />cost of $19,000. <br />Item 9: The County Attorney will review a legal issue entitled, <br />"In Regard: Plywood Antitrust Litigation". <br />Mr. Gledhill stated that some solftwood plywood manufactors are being <br />sued claiming there are antitrust problems. The County has since 1963 pur- <br />chased some softwoed plywood and as purchaser become members of a class of <br />people who have been damaged by the antitrust problem. He stated the <br />County would be a part of the class suit unless otherwise stipulated before <br />March 10, 1978. If no action is taken, the County becomes a part of the <br />class and would tlet same portion of the monies obtained through the litiga- <br />tion. The only expense to the County will be a research of the records <br />since 1963 by staff members to find out what softwood plywood has been pur- <br />chased. He then recommended to the Board that the County stay under the <br />class action status. <br />Upon motion of Cammissoner Gustaveson, seconded by Commissioner Pinney, <br />it was moved and adopted that Orange County remain a member of the Class <br />Action suit. <br />The County Attorney informed the Board of a Declaratory Judgment Action <br />which has been brought by the E & M Enterprises. The action is to estab- <br />list whether the law which states there can be no more than one adult type <br />entertainment in one establishment is constitutional or not. The Orange <br />County Sheriff has been named as a defendent in this action. He stated <br />that until this law is declared unconstitutional, the Sheriff must enforce <br />the law. , <br />Upon motion of Commissioner Gustaveson seconded by Commissioner Pinney, <br />it was moved and adopted to authorize the County Attorney to do whatever is <br />necessary in behalf of the sheriff in his role of upholding the laws of <br />Orange County. <br />The County Attorney was asked to discuss the proposed Insulation <br />Ordinance which had previously been presented to the Board of Commissioners. <br />Mr. Gledhill stated the Ordinance was similar to the proposal presented <br />by the County Commissioners Association. Some changes have been made as <br />indicated by members of the Board of Commissioners. The County Attorney <br />proceeded to review with the Board the Insulation Ordinance. <br />The County Commissioners requested the County Attorney clarify the <br />language under Section IX - A- Purchase of Bonds. The Insulation Ordinance <br />will be discussed further as soon as the Attorney drafts new language for <br />Section IX. <br />
