Harvey, Planner <br />P <br />Phone Number <br />245 -2592 <br />245 -2607 <br />PURPOSE: To hold a public hearing on a staff generated Zoning Ordinance Text Amendment <br />seeking to modify existing development limitations on non - residential development within <br />Nodes. <br />BACKGROUND: At the November 24, 2008 Quarterly Public Hearing, the Board processed a <br />petition seeking to rezone 1.04 acres of a 4.7 acre parcel within the White Cross Rural Community <br />Activity Node. <br />As staff stated during the hearing, the Orange County Zoning Ordinance (hereafter `the <br />Ordinance') limits the total amount of non - residentially zoned property permitted within a Node <br />based on population density. Unless population density within a Node is comparable to existing <br />Transition Areas, the Ordinance reduces the amount of permitted non - residentially zoned <br />property. In the case of the White Cross Rural Community Activity Node, the total cumulative <br />amount of non - residentially zoned property permitted within the area is limited to ten (10) acres. <br />Staff stated that the Node had nine point four (9.4) acres of commercially zoned property. As a <br />result, staff recommended denial of the rezoning petition. <br />During the hearing, several comments were made over the need to re- evaluate existing development <br />limitations within the Nodes and determine if existing limitations on non - residentially zoned property <br />were appropriate. <br />
