82 <br />Attachment One (1): Resolution <br />April 21, 2009 <br />WHEREAS on July 15, 2975 Orange County became a participant In the Emergency Phase of the National <br />Flood Insurance Program thus making flood insurance available to property owners through the National Flood <br />Insurance Program (NFIP), and <br />WHEREAS on March 16, 1981 the Federal Emergency Management Agency (FEMA) converted the County <br />into the regular phase of the NFIP bringing full benefits to the citizens of the County, and <br />WHEREAS there are currently sixty-two (62) flood-insurance policies enforced within the unincorporated <br />portions of Orange County, and <br />WHEREAS the County is required to maintain *an updated Flood Damage Prevention Ordinance (FDPO) in <br />order to remain eligible for the NFIP, and <br />WHEREAS the County desires to repeal its existing FDPO and adopt the following regulations in order to be <br />in full compliance with Federal and State requirements for flood damage prevention programs, and <br />WHEREAS pursuant to the authority granted to counties by Article 6 of Chapter 153A of the North Carolina <br />General Statutes' (NCGS), sp=Mcauy NCGS 153A -121, the County hereby enacts the following flood damage <br />regulations to protect the•health; safety, and welfare of the citizens of Orange County, and <br />WHEREAS pursuant to the authority granted to. counties by,Parts 2, 3 and 4 of Article 18 of Chapter 153A of <br />the NCGS, specifically including NCGS 153A-340, f r the NCGS se of protecting the health, safetysan;d the County hereby <br />general welfare of <br />enacts the following flood damage regal P� p <br />the citizens of Orange County, and <br />WHEREAS pursuant to. the authority granted'to counties by Part 6, Article 21 of Chapter 143 of the NCGS, <br />specifically including NCGS 143- 215.54, NCGS 143 - 215.56, and NCGS 143 - 215.61 the County hereby enacts the <br />following flood damage regulations to protect the health, safety, and general welfare of the citizens of Orange <br />County, and <br />WHEREAS pursuant to the authority granted to counties by Part 3, Article 4 of Chapter 153A of the NCGS, <br />specifically NCGS 153A -47, a county may in an ordinance adopt by reference to a published technical code or a <br />standard or regulation promulgated.by a public agency, <br />
