Attachment 1 <br />A RESOLUTION AMENDING <br />THE ORANGE COUNTY ZONING ORDINANCE <br />BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF ORANGE <br />COUNTY, NORTH CAROLINA, hereby amends the Orange County Zoning Ordinance <br />by adding (indicated by double underlined .language) and deleting (indicated by stricken <br />through language) as follows: <br />PART I: That Section 7.2.8 be amended as follows: <br />With respect to the commencement of construction for an approved <br />Planned Development, the following standards shall apply <br />1. Site Specific Development: In instances where an applicant is <br />proposing the development of a specific land use on a specific <br />parcel of property, construction shall commence and proceed at a <br />reasonable rate within twelve (12) months from the date the permit <br />is approved by the County Board of Commissioners. <br />The applicant may receive a single six (6) month extension from <br />the Zoning Officer extending the timeline for the commencement <br />.of construction activities if the applicant can provide evidence <br />indicating that: <br />a. The applicant has, in good faith, pursued in a timely <br />manner any and all permits associated with the <br />commencement of construction activities for the project, <br />b. That the need for the request is based on an agencies <br />review /processing of a permit application, and <br />c. That the request is not the result of the inability of the <br />applicant to submit the required permit applications and <br />that the need for the extension results from factors be and <br />the applicants control. <br />
