3 <br />DRAFT # 1.5 <br />accessibility of public places and to enrich the experience and expand the participation of <br />citizens in the visual arts, by directing additional resources for the inclusion of public art in <br />Orange County (hereafter "Public Art"). <br />Section 2.0 Program Policy: The BOCC acknowledges that there is a significant need to <br />provide adequate funding for the creation, support, display and maintenance of Public Art. <br />The BOCC is determined to dedicate to the Percent for Art Program one (1 %) percent of the <br />Eligible Construction Budgets of Eligible Construction Projects in the Capital Improvement <br />Program in the adoption of the final budget policy for each fiscal year. The funds shall be <br />used for artist design services and for the selection, acquisition, display and maintenance of <br />Artwork in new and existing public buildings and parks and other outdoor public'site or lands <br />in Orange County. The Percent for Art Program and its policies shall be effective upon the <br />adoption of this Resolution. <br />Section 3.0 Definitions: <br />a. "Artist" means a practitioner of the visual arts who is generally recognized by critics and <br />peers as a professional of superlative intent and ability. <br />b. "Artwork" means works in a variety of media produced by Artists; works may be <br />permanent, temporary or functional, may be standalone~or integrated into the architecture <br />or landscaping, if such are designed by an Artist as defined above; and should <br />encompass the broadest range of expression, media and materials authorized by N.C. <br />Gen. Stat. § 160A-488 or its successor statute. The term "Artwork" does not include <br />inappropriate expenditures including, but not limited to: (a) reproductions of original art by <br />mechanical or other means (however, limited editions controlled by.the artist, or original <br />prints, cast sculpture, photographs, etc:, may be included) and (b) art objects which are <br />mass produced, ordered from a catalog, or of a standard design, such as playground <br />sculpture or fountains. <br />c. "Arts Commission" means the Orange County Arts Commission. <br />d. "Capital Improvement Program° means the Orange County program for capital <br />development. <br />e. "Eligible Construction Project" means any project included in the Orange County Capital <br />Improvement Program that is wholly or partially funded or otherwise authorized by the <br />BOCC for construction, involving any building or park or other outdoor public site or lands <br />to which the public has access or which is visible from a public right-of--way. <br />f. "Eligible Construction Budget" means the total amount appropriated for the design, <br />construction, renovation of Eligible Construction Projects, but excluding the acquisition of <br />land, demolition costs, sitework and soil remediation and mechanical equipment costs. <br />Said funds shall include eligible bond projects, eligible grant-funded projects and other <br />eligible capital projects funded from other sources, but shall exclude grants for which the <br />
