Minutes from May 18, 2009 Quarterly <br />Public Hearing. <br />PURPOSE: To receive the Planning Board and staff recommendation(s) and consider taking <br />action on a staff initiated Zoning Ordinance Text Amendment to Section 6.23.1 of the Zoning <br />Ordinance (hereafter `the Ordinance) seeking to allow the development of non-residential land <br />uses within certain critical and protected watershed overlay districts in instances where such <br />areas are located within previously identified Rural Community Activity Nodes. <br />BACKGROUND: This item was presented at the May 18, 2009 Quarterly Public Hearing. As staff <br />stated during the hearing, the Ordinance, specifically Section 6.23.1, currently prohibits the <br />development of non-residential land uses within the <br />A. University Critical and Protected, <br />B. Cane Creek Critical, and <br />C. Upper Eno Critical <br />Watershed Overlay Zoning Districts. Approximately three quarters of the Cedar Grove Rural <br />Community Activity Node (Attachment Three) is located within the Upper Eno Critical Watershed <br />Overlay District. This area cannot be developed for non-residential uses. There is also a Rural <br />Industrial Node located within the University Lake Protected Watershed Overlay District that is <br />similarly restricted. <br />
