STRATEGIC GROWTH AND RESOURCE CONSERVATION PROGRAM <br />Final (8.7.2009) <br />C. Ordinance Modifications for SGRC Program Implementation <br />To implement the Strategic Growth and Resource Conservation Plan (SGRC) as part of <br />the Comprehensive Plan, the County intends to rely on Development Agreements <br />between the County and the Growth Area landowner and the conditional zoning <br />provisions of the County's existing land development ordinances. NC counties are <br />authorized to use conditional zoning by NC General Statute Chapter 153A, Article 18, <br />part 2 (NC G.S. 153A -342), as enacted in 2005. <br />The existing conditional zoning ordinance provisions will need to be modified by the <br />addition of a few considerations that are particular to the SGRC, specifically: <br />All SGRC Growth Area applications for conditional zoning must include the <br />following: <br />3$ A Conservation Easement Agreement <br />• placing a permanent conservation easement on all or a portion of a <br />Conservation Area property, where the Conservation Area property or <br />portion thereof: <br />o meets the eligibility requirements of the SGRC program, and <br />o is in the same river basin as the Growth Area property for which the <br />conditional zoning application is being made <br />• between the owner(s) of the SGRC - eligible Conservation Area property <br />owner and the County <br />o fully executed and meeting the content requirements for such <br />o agreements as adopted by the County as part of the SGRC <br />• A Development Agreement whose execution is contingent upon approval of <br />the conditional zoning application <br />• between an SGRC - eligible Growth Area property owner and the <br />County <br />• specifying the extension of public utilities and services to be provided <br />by the County <br />• specifying the requirements or limitations on any aspect of <br />development to be provided by the property owner (the developer), <br />including but not limited to: <br />■ density or intensity of development, <br />■ design of buildings and other elements of the proposed development <br />■ infrastructure or other public facilities <br />■ impervious cover limitations <br />■ tree save /planting, other open space <br />• incorporating by reference a "SGRC Growth Area Concept Plan ", analogous <br />to those currently required under the County's subdivision ordinance (Sec. 46- <br />123 of the Code of Ordinances of Orange County) <br />An option for an SGRC Growth Area application for conditional zoning for <br />inclusion of third party- certified environmentally sensitive building or site design <br />practices or standards in the Development Agreement, and the awarding of <br />commensurate "bonus points" that translate into additional allowable <br />development density or intensity. <br />ORANGE COUNTY, NORTH CAROLINA <br />
