ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />AND PLANNING BOARD <br />QUARTERLY PUBLIC HEARING ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: August 24, 2009 <br />Action Agenda <br />Item No. C.2 <br />SUBJECT: Acceptance of the Phase III (Program Implementation Plan) of the Strategic <br />Growth and Rural Conservation Feasibility Study <br />DEPARTMENT: Planning and Inspections PUBLIC HEARING: (Y /N) Yes <br />ATTACHMENT: Final Report INFORMATION CONTACT: <br />Craig Benedict 245 2592 <br />Glenn Bowles, 245 2577 <br />PURPOSE: To consider accepting the Phase III of (Program Implementation Plan) of the <br />Strategic Growth and Rural Conservation (SGRC) Feasibility Study. <br />BACKGROUND: The BOCC retained The Louis Berger Group and the University of North <br />Carolina — Charlotte Urban Institute (hereafter 'the Consultant') to complete Phase III of the <br />Transfer of Development Rights (TDR) study. The Phase III study is a continuation of the first <br />two phases (background data collection and feasibility), which the Consultant completed in the <br />fall of 2006. <br />The original contract timeline proposed the completion of work on Phase III to occur in late <br />2007. Several mitigating factors, however, contributed to the extension of the project including <br />various delays in scheduling meetings with appropriate stakeholders and advisory groups and <br />the BOCC suggestion that staff focus on the adoption of the 2030 Comprehensive Plan in 2008. <br />General comments received during public presentations also prompted more extensive <br />deliberations. <br />After the Comprehensive Plan was adopted in October of 2008 the BOCC suggested bringing <br />back the consultant work product to complete the project. It needs to be remembered that the <br />acceptance of this final work plan will not implement the program. The final report will, <br />however, detail facets the County ought to consider when identifying possible ordinance <br />development to implement the program. <br />Transfer of Development Rights (now referred to as Strategic Growth and Rural <br />Conservation) program timeline. <br />• June through November 2004: <br />1.
