dR b- x009 - Oa q Attachment 1 <br /> <br />AN ORDINANCE AMENDING <br />THE ORANGE COUNTY ZONING ORDINANCE <br />WHEREAS, there has been heightened scrutiny over existing regulations relating <br />to the review, processing and approval of extensions on the commencement of <br />construction activities for approved Planned Development projects, and <br />WHEREAS, for large scale Planned Development projects there is a potential <br />problem in adhering to the existing twelve (12) month construction commencement <br />requirement relating to the need to secure any and all local, State, and Federal permits <br />to allow development to commence, and <br />WHEREAS, the current regulations do not take into account the timeline <br />necessary to secure these necessary permits to allow for construction to commence, <br />and <br />WHEREAS, the Ordinance currently does not contain any standard outlining how <br />a decision can be made relating to the approval or denial of an extension request, and <br />WHEREAS, the process necessary to review extension requests is not clear and <br />is open for interpretation, and <br />WHEREAS, the proposed amendment establishes a definable standard relating <br />to the submission, review, and disposition of extension requests eliminating existing <br />ambiguity. <br />BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF ORANGE <br />COUNTY, NORTH CAROLINA, hereby amends the Orange County Zoning Ordinance <br />by adding (indicated by double underlined language) and deleting (indicated by stricken <br />through language) as follows: <br />PART I: That Section 7.2.8 be amended as follows: <br />A.
