3 <br />draft ordinance language was provided by Carrboro staff and much of the discussion was <br />related to this. Ten Planning Board members were in attendance although one had to <br />leave before the vote. In the audience were Roy Williford and Trish McGuire of the <br />Carrboro Planning Staff; Alderman Alex Zaffron; former Alderman Jay Bryan; <br />Ordinance Drafting Committee members Jean Earnhardt and Giles Blunden; and <br />Calvander residents Jef, David Rutter, and Christie Boros. <br />Following a three hour discussion, the Planning Board voted six (6) to three (3) in favor <br />of the following: <br />....that the Planning Board approve the proposed amendments to the Joint <br />Planning Area land Use Plan and map to incorporate the Facilitated Small Area <br />Plan for Carrboro's Northern Study Area; and, approve proposed amendments to <br />the Joint Planing Agreement to incorporate the Facilitated Small Area Plan for <br />Carrboro's Northern Study Area provided that the Orange County Commissioners <br />are included in the decision making process on "floating" conditional use zoning <br />districts in the CJDA Transition Area; and that the County appoint the advisory <br />board, and more specifically, that Subsection 2.6E of the agreement is amended <br />by rewriting the second sentence and by adding a new third sentence to read as <br />follows: "With respect to property that is located within the CJDA Transition <br />Area, changes in zoning classifications including changes to the `floating' <br />conditional use districts designed to implement the recommendations of the <br />`Facilitated Small Area Plan for Carrboro's Northern Study Area' (i.e., changes to <br />Carrboro's Traditional Neighborhood conditional use district or Office /Assembly <br />conditional use district) may not be made unless and until an ordinance approving <br />such zoning map classifications has been approved by both Orange County and <br />Carrboro following a joint public hearing by the two governing bodies. <br />RECOMMENDATION: Following review of the July 15 and November 11 deliberations of the <br />Planning Board, there are two options the Administration wishes the Board of <br />Commissioners to consider: <br />1) Adoption of the Planning Board recommendations: Acceptance of the <br />recommendations indicates continued commitment to Joint Planning and the <br />process for amending the agreement and plan. Furthermore, acceptance <br />indicates direct Commissioner involvement in land use decisions affecting <br />Transition Area residents who are subject to Carrboro land use regulations, but <br />vote only for Orange County Commissioners. An implication to consider, <br />however, is the complexity of the "floating" conditional use zoning process which <br />is quasi-judicial and analogous to Orange County's Planned Development/Special <br />Use Permit process. <br />2) Do not accent the Planning Board recommendations: Denial of <br />recommendations could be interpreted as satisfaction with the existing <br />agreement and plan recommendations for the Carrboro Transition Area. <br />
