(~v .) <br />Gommissioner Willhoit suggested that the Board give .specific dizec- <br />tions to the Planning Staff, and that a xe.y~.eFt o~ pxpg~e~s ~*}ade ~.n <br />establishing the Councils be made at each Gommissioner~s meet7.ng. Mrs <br />Willhoit added that he felt the establishing of the Councils could be <br />done fairly quickly. <br />It was pointed out that when the Advisory Councils were first <br />conceived last December, the primary function was to develop the land <br />use plan and the zoning map. The recommendation of the Planning Boaz'd <br />to the Commissioners is that the Advisory Councils study the Subdivision <br />Regulations before extending county-wide. <br />Gommissioner Gustaveson recommended that the third Tuesday 7,n ..: <br />September be scheduled as the time to consider implementing the SuFa~ <br />division Regulations county-wide and that this implementing would be <br />no sooner than 30 days from the thixd Tuesday, but could be longer if -° <br />there is a need for further discussion <br />Upon motion of Commissioner Pinney, seconded by Commissioner ~7hitted, <br />it was moved and adopted that the Board will review the proposed Subs <br />division Regulations on September 20, 1977, an progress on the Advisory <br />Councils and the educational program. <br />Concerning the amendments to the Subdivision Ordinance, Comm3.ssioner <br />Willhoit moved that the County Attorney review the proposed changes to the <br />amendments, clarify the changes with the Planning Board, have the document <br />retyped and then submit again to the Commissioners for approval. <br />This motion died for lack of a second, <br />The County Attorney cited sertain problems he had with the changes <br />to the amendments. <br />Section III-D-4, the wording was changed to read, "The following <br />agennies shall review and certify areas of responsibility...." <br />Section IV B 6, Subsection (c) will be added and will read.... <br />"It is not the intend of this section that the terms of any easement or <br />way required above be dictated by Orange County. Any such terms and <br />conditions may be negotiated between the developer/land owner and utility <br />companies, provided however, that where public water and sewer are re- <br />gired for approval the Planning Board may require an instrument executed <br />by the developer/land owner and utility company setting forth said terms <br />and conditions at the time the preliminary plan is reviewed by the Planning <br />Board." <br />The new wording for Section Vx22-A: Amendments is as follows: <br />"...initiated by the Board of Commissioners, by the County P..lanning <br />Board, or by petition of any citizen of Orange County. After due con- <br />sideration, the Planning Board may initiate the amendment provers...." <br />Commissioner Gustaveson stated that he felt the recommendation of the <br />Planning Board to implememt the amendment in Chapel Hill and Eno Townsfii_ps <br />by July 19, 1977 is too soon and recommended that implementation be <br />effective after the August meeting of the Planning Board. <br />Commissioner Gustaveson then moved that the amendments to the Sub- <br />division Ordinance be effective in Chapel Hill and Eno Township after the <br />August meeting of the Planning Board -August 16,1977. <br />Commissioner Willhoit seconded the motion. <br />Commissioner Pinney stated that he owned 40 acres of land in Chapel <br />Hill Township and he saw no problems with the Ordinance hurting his land <br />and he would vote for the implementation of the Ordinance. Commissioners .. <br />Pinney called for the question. <br />The Chairman called for a vote on the motion, and all members of the <br />Board voted aye. The motion was declared passed. <br />Mr. Gledhill brought to the attention of the Board a question which <br />was raised at a previous meeting regarding the vote of the Planning Board. <br />He stated that the Planning Board establsihed their awn rules as to whether <br />or not a member could abstain from voting. <br />
