9 <br />ADDED ITEM <br />D. PINEY MOUNTAIN GRANT AWARD AND FORMAL ACCEPTANCE BY BOARD OF <br />COUNTY COMMISSIONERS <br />County Engineer Paul Thames presented a resolution accepting the <br />grant offer from the North Carolina Department of Environment, Health and <br />Natural Resources for construction of the Piney Mountain sewer pump <br />station and force main. <br />A motion was made by Commissioner Crowther, seconded by <br />Commissioner Halkiotis to adopt the resolution as stated below which <br />stipulates that the Board of County Commissioners agrees to meet all 15 <br />stipulations and authorize the County Manager to execute all grant <br />documents. <br />RESOLUTION ACCEPTING THE OFFER OF A HIGH UNIT COST GRANT FROM <br />THE STATE CLEAN WATER REVOLVING LOAN AND GRANT PROGRAM <br />FOR <br />THE CONSTRUCTION OF A PUMP STATION AND FORCE MAIN <br />TO SERVE THE PINEY MOUNTAIN SUBDIVISION <br />WHEREAS, it has been determined that the Piney Mountain Subdivision's on- <br />site wastewater treatment system has failed and that the sole remedy is <br />the construction of a sewerage pumping station and force main which will <br />connect the STEP and collection systems serving the subdivision to the <br />collection system owned and operated by the City of Durham; and <br />WHEREAS, Orange County, Orange Water and Sewer Authority and the Piney <br />Mountain Homeowners Association have entered into a series of agreements <br />governing the financing, construction, operation and use of the collection <br />system, pump station and force main; and <br />WHEREAS, Orange Water and Sewer Authority and the City of Durham have <br />entered into an agreement permitting the City to receive wastewater from <br />the Piney Mountain Subdivision; and <br />WHEREAS, Orange County, on March 31, 1994, submitted an application for a <br />High Unit Cost Grant from the State Clean Water Revolving Loan and Grant <br />Program; and <br />WHEREAS, the North Carolina Environmental Management Commission, in <br />September 1994, did allocate $88,500 in High Unit Cost Grant funds for the <br />construction of a wastewater pumping station and force main to serve the <br />Piney Mountain Subdivision; and <br />WHEREAS, Orange Water and Sewer Authority has advertised bidding, accepted <br />bids, awarded a bid, given notice to proceed and supervised the execution <br />of the contractual construction activities necessary to build a wastewater <br />pumping station and force main; and <br />WHEREAS, the property owners in the Piney Mountain subdivision, though the <br />Piney Mountain Homeowners Association, have collected and deposited with <br />Orange County some $348,850 to fund the construction of the wastewater <br />pumping station and force main; and <br />WHEREAS, Orange County has created a project account with the funds <br />provided by the Piney Mountain Homeowners Association and has either <br />
