2 <br />Session of the NC General Assembly by adding a section that would <br />authorize the establishment of deferral agreements between the County <br />and State and federal agencies. <br />A motion was made by Commissioner Willhoit, seconded by <br />Commissioner Halkiotis to adopt the proposed resolution as attached to <br />these minutes on pages and to authorize the County Attorney <br />to transmit it to the Orange County legislative delegation. In the <br />event amendment of the 1995 Orange County omnibus local legislation is <br />not possible, the Manager further recommends that the Board authorize <br />the County Attorney to present this legislative initiative to the <br />Orange County legislative delegation at the first possible opportunity. <br />VOTE: UNANIMOUS <br />VI. Petition for Abandonment of Right-of-Way - Duke Forest Road <br />A public hearing was held to hear citizen comments on an order <br />closing a right-of-way located between University Station Road and <br />Murphey School Road located in Duke Forest. All requirements for <br />closing a road have been met. No comments were received.. <br />A motion was made by Commissioner Gordon, seconded by Commissioner <br />Halkiotis to close the public hearing. <br />VOTE: UNANIMOUS <br />A motion was made by Commissioner Gordon, seconded by Commissioner <br />Crowther to adopt the order as stated below: <br />NOTICE OF THE ADOPTION BY THE ORANGE COUNTY <br />BOARD OF COMMISSIONERS OF A RESOLUTION <br />EXPRESSING THE INTENT OF THE BOARD OF <br />COMMISSIONERS OF ORANGE COUNTY TO CLOSE <br />A RIGHT-OF-WAY LOCATED BETWEEN <br />UNIVERSITY STATION RD (SR 1752) AND MURPHEY SCHOOL RD (SR 1714) <br />IN DUKE FOREST <br />RESOLUTION OF THE ORANGE COUNTY <br />BOARD OF COMMISSIONERS OF INTENT <br />TO CLOSE A RIGHT-OF-WAY IN DUKE FOREST <br />WHEREAS, petitioners Alfred S. Kirkland, Jane C. Kirkland and Judson <br />Edeburn (for Duke Forest and Duke University) have filed a petition <br />before the Board of County Commissioners to close a right-of-way <br />identified on the map which is part of Exhibit A incorporated herein by <br />reference, the Board of County Commissioners, on March 8, 1995, adopted <br />a resolution declaring its intent to close the right-of-way identified <br />on the map which is part of Exhibit A (hereinafter "The abandoned right- <br />of-way"); and <br />WHEREAS, it appears that no individual, firm or corporation owns <br />property in the vicinity of said right-of-way without a reasonable means <br />of ingress and egress to his, her or its property; . <br />WHEREAS, as provided by law, the Board of Commissioners of Orange <br />County have conducted a public hearing following notice as required by <br />law, in order to determine that the closing of the abandoned right-of- <br />way is not contrary to the public interest and in order to determine <br />that no individual owning property in the vicinity of the abandoned <br />right-of-way or in the area which it is located would thereby be <br />
