assigmnents of rights, and other documents as may be necessary to allow the University to <br />perform its obligations under this Agreement. <br />76. The County shall make available to the University copies of all enviromnental <br />information, reports, studies, landfill gas feasibility reports, assessments or other documents <br />affecting the generation of Landfill Gas or the LFG Project that the County has prepared or that <br />have been prepared on the County's behalf. Such documents include those the County is <br />required to submit to the North Carolina Department of Enviromnent and Natural Resources. <br />77. The County shall reasonably ensure that the County, its employees and <br />contractors do not damage the LFG Project or disrupt the operation of the system. Should such <br />damage occur, the University has the right to take inunediate action to effectuate whatever <br />repairs are necessary to bring the LFG Project into fully operational condition and the County <br />shall timely reimburse the University for the reasonable costs of repair. <br />78. The County shall retain the sole and exclusive right, and shall have all obligations <br />with regard to, Landfill operations and for meeting all applicable Laws pertaining to such <br />operation, exclusive of the University's operation of the LFG Project. <br />D. Oneratin~ Protocols <br />79. The Parties agree to develop and implement operating protocols for the LFG <br />Collection System, including, without limitation, monitoring and reporting procedures, <br />communications and emergency response plans, and notification procedures. <br />ARTICLE III <br />PERMITTING AND CONSTRUCTION OF FACILITIES <br />80. The installation and construction of the LFG Project shall be the sole <br />responsibility and be undertaken at the sole expense of the University, and shall be carried out in <br />20 <br />
