sss <br />Discussion ensued. Commissioner Gustaveson stated that when this <br />request was heaxd at the public hearing there were people who were pre- <br />sent who were concerned about the planning for this particular area. He <br />stated that he had not changed his opinion from the earlier decision which <br />was based on good planning. <br />Mr. Walker pointed out that the Planning Board had recommended that <br />this rezoning request be approved. <br />The Chairman called for the vote on the motion. Voting aye were <br />Commissioners Walker, Whitted, and Pinney. voting nay were Commissioners <br />Willhoit and Gustaveson. The motion was declared passed. <br />Commissioner Gustaveson stated further that operation of this garage <br />was in violation of the law, and that he felt the Planning Staff should - <br />look into this situation. <br />The Chairman requested the Planning Staff notify the adjoining pro- <br />perty owners of this rezoning reconsideration. <br />Upon motion of Commissioner Pinney, seconded by Commissioner Whitted, <br />it was moved and adopted that the Planning Staff should notify the adjoin- <br />ing property owners and inform them of their opportunity to speak fox or <br />against this rezoning reconsideration <br />The County Managex suggested that the Board discuss the sell of <br />palmistry license next. He stated that a request had been received for <br />such a license. <br />Chairman Whitted stated that previous action of this Board regarding <br />this matter was to request the General Assembly to exclude Orange County <br />from the State law which prohibits palmistry in Orange County, and that <br />this was granted. <br />The County Attorney stated that the County could regulate such <br />activity as palmistry by an ordinance or by setting fees. The State <br />has a minimum recommended fee of $200 for Counties to charge. The State <br />fee is $500 per County. <br />The County Manager stated that near-by counties have a set fee of - <br />between $200 and $500. Further discussion ensued regarding the sell of <br />different license in the County. <br />Commissioner Pinney moved that the palmistry license in Orange <br />County be set at $1,000. <br />This motion died for lack of a second. <br />Commissioner Gustaveson moved to set the fee of palmistry license at <br />$200. Commissioner Whitted seconded the motion. <br />Further discussion ensued. Commissioner Pinney stated that there <br />could be many problems with this type of trade and that he felt the fee <br />should be at least the same as Chapel Hill, which is $500. <br />Mr. Pinney moved that the motion be amended to set the fee for the <br />sell of palmistry license at $500. Commissioner Walker seconded the <br />motion of Mr. Pinney. ~ <br />Tha Chairman called for a vote on Commissioner Pinney's motion. <br />Voting aye were Commissioners Walker, Willhoit, and Pinney. Voting nay <br />were Commissioners Whitted and Gustaveson. The motion was declared <br />passed. <br />The County Attorney informed the Board that this action appears to <br />have the effects of an Ordinance and when an Ordinance is not passed un- <br />animously on the first reading, it must be brought to the Board again <br />wihtin 100 days. The second reading of this would pass with a majority <br />vote. <br />The item will appear on the agenda at the May 2nd meeting. <br />Chairman Whitted referred to Item 3: Plats for Consideration: He <br />recognized Mr. Chris Edwards from the Planning Staff. <br />
