L`. <br />NORTH CAROLINA <br />ORANGE COUNTY <br />RESOLUTION <br />WHEREAS on January 26, 1976, the Mayor and the Board <br />of Alderman of the town of Chapel Hi11 requested that the <br />Board of County Coznmissianers of Orange County consent to axx••- .__ <br />extension of the town's extraterritorial planning and regulation <br />of development jurisdiction pursuant to North Carolina General <br />Statutes ~ 1fi0A-360(a); and <br />WHEREAS an March 9, 1976, the Board of County Commis- <br />sioners, upon the advise of the County Attorney, elected to take <br />no action on the town's request until such time as the Commission <br />could determine whether the Town Chartex authorized the tawn'to. <br />request an expansion of its planning-and regulation of develop- <br />ment jurisdiction; and <br />WHEREAS the Town Attorney and the County Attorney, <br />pursuant to the instructions of their respective boards, framei-- <br />a joint request for an opinion of the Attorney General resaly- _ <br />ing this matter; and <br />WHE1~A5 on December 7, 1976, the County Attorney re- <br />ceived a response from the Attorney General which 'was incon- <br />clusive; and <br />WHEREAS the Orange County Board of County Commissioners <br />has been informed that the town of Chapel Hill has requested <br />that the County's representatives in the General Assembly <br />sponsor legislation amending Section 5.18 of the Chapel Hill <br />Town Charter to clarify the authority of the town of Chapel <br />Hill to request an expansion of its planning and regulation of <br />development jurisdiction; and <br />WHEREAS there is a legal question as to whether the <br />Carrbaro Town Chartex, as it presently reads, authorizes the <br />town of Carrboro to request an expansion of its planning and <br />regulation of development jurisdiction; and <br />
