24 <br />Exhibit D <br />AN ACT TO CLARIFY THE AUTHORITY OF ORANGE COUNTY TO REGULATE THE <br />USE, STORAGE, DISPOSAL, LABELING, OR APPLICATION OF PESTICIDES IN <br />AREAS SUBJECT TO REGULATION BY THE NORTH CAROLINA PESTICIDE BOARD <br />IN EXERCISING ITS PLANNING AND ZONING AUTHORITY UNDER ARTICLE 18 <br />OF CHAPTER 153A OF THE GENERAL STATUTES <br />The General Assembly of North Carolina enacts: <br />Section 1. North Carolina General Statutes § 143-465(d) is <br />amended by adding the following sentence to the end thereto: <br />"Notwithstanding the first sentence of this subsection, <br />Orange County, in the exercise of its planning and zoning <br />authority under Article 18 of Chapter 153A of the General <br />Statutes, may, in a manner more stringent than any rule, <br />regulation or resolution adopted by the North Carolina <br />Pesticide Board, regulate the use, storage, disposal, <br />labeling, or application of pesticides." <br />Sec. 2. This act applies only to Orange County. <br />Sec. 3. This act is effective upon ratification. <br />lsg-8 <br />pest.exD <br />
