,ce `1i /19/98 �►RAFT�,COPY¢OF PROPOS DN S ORDCNANCE, <br />1 constructed within buffer areas designated under this section under circumstances <br />2 where such location is practicably unavoidable if the subject property is to be <br />3 served under the provisions of Section 15- 238(c) and an alternate design would <br />4 result in greater damage to the environment, so long as such sewer line is located to <br />5 the extent practicable at least twenty -five feet from the edge of any stream bank. <br />6 <br />7 <br />8 <br />9 SECTION 20. Subsection 316(c) is deleted and the following subsection (c) is inserted in lieu <br />10 thereof: <br />11 <br />12 (c) There shall be no clearcutting in any development within the Transition Area portion <br />13 of the Carrboro Joint Development Area as identified in the Joint Planning Agreement. The term <br />14 " clearcutting" shall refer to the large- scale, indiscriminate removal of trees, shrubs, and undergrowth <br />15 with the intention of preparing real property for nonagricultural purposes. <br />16 <br />17 SECTION 21. Article XIX is amended by adding a new Section 15 -312 to read as follows: <br />18 <br />19 Section 15 -312 Protective Buffer Along Major Roads <br />20 <br />21 Notwithstanding the provisions of Section 15 -308, an undisturbed protective buffer shall be <br />22 maintained along Old N.C. 86, Dairyland Road, Union Grove Church Road, Homestead Road, Eubanks <br />23 Road and Smith Level Road south of Ray Road that will help preserve the scenic views and elements of this <br />24 area. This buffer shall be established by measuring along a line perpendicular to the right -of -way of these <br />25 roads one hundred (100) feet. If the buffer area does not provide the equivalent of a Type `A' screen, the <br />26 developer shall provide a Type `A' screen on the development's side of the buffer (one hundred (100) feet <br />27 from the right -of -way). <br />28 <br />29 SECTION 22. Appendix E is amended by deleting subsection E -10 (D)(9) ( "Wintergreen <br />30 Barberry") and subsection E -10 (F)(10) ("Japanese Barberry"). <br />31 <br />32 SECTION 23. Appendix E is amended by adding a new Section E -17 to read as follows: <br />33 <br />34 E -17 List of Invasive Plant Species'. <br />35 <br />36 The following plant species shall be prohibited when complying with the shading and landscaping <br />37 provisions of this chapter. <br />38 <br />Akebia quinata <br />Chocolate vine <br />Acer ginnala <br />Amur Maple <br />Acer platanoides <br />Norway Maple <br />39 All Berberis species including <br />Berberis julianae <br />Wintergreen Barberry <br />Berberis thunbergii <br />Japanese Barberry <br />40 All Cotoneaster species including <br />Cotoneaster microphyllus <br />Littleleaf Cotoneaster <br />(Page 29 of 33 <br />
