Development of a size and scale, which accommodates and promotes <br />pedestrian travel rather than motor vehicle trips within the village. <br />10. Compliance with the policies embodied in this chapter for the <br />development of a village mixed use. <br />(b) The VMU district shall be a conditional use district authorized under <br />N.C.O.S. 160A -382. As such, property may be placed within this district only in response <br />to a petition by the owners of all the property to be included. <br />(c) As indicated in the Table of Permissible Uses, the only permissible use <br />within a VMU district is a village mixed use development, and a village mixed use <br />development is only permissible within a VMU district. <br />(d) Property may be rezoned to the VMU district only when the property <br />proposed for such rezoning: <br />(1) Comprises at least fifty, but not more than two hundred, contiguous <br />acres. For purposes of this subsection, acreage is not "contiguous" to <br />other acreage if separated by a public street or connected only at a <br />point less than one hundred feet in width; and <br />(2) Ts so located in relationship to existing or proposed public streets that <br />traffic generated by the development of the tract proposed for <br />rezoning can be accommodated without endangering the public <br />health, safety, or welfare; and <br />3 Will be served b OWASA water and sewer <br />() y limos whendevelped; <br />(e) No more than 350 grog` acres may be rezoag..the VMU district and <br />no more than three villages may be approved. <br />(f) Nothing in this section is intended to limit the discretion of the board of <br />aldermen to deny an application to rezone property to a VMU district if it <br />determines that the proposed rezoning is not in the public interest. <br />(g) When a VMU rezoning application is submitted (in accordance with Article <br />XX of this ordinance), the applicant shall simultaneously submit either (i) a conditional use <br />permit application for a village mixed use development in accordance with the provisions of <br />Section 15 -176.1 of this chapter, or (ii) an application for approval of a master plan for the <br />proposed village mixed use development, in accordance with the following provisions. <br />(1) The master plan shall show, through a combination of graphic means <br />and text (including without limitation proposed conditions to be <br />included in the conditional use permit for the proposed <br />development); <br />
