v <br />2 <br />The southern two- thirds of the subdivision is located in the U- ENO -PW (Upper Eno <br />Protected Watershed). The upper one -third is undesignated. Impervious surface <br />limitations in the U- ENO -PW are 12 percent for existing and new lots outside Transition <br />Areas as designated in the Land Use Element of the Comprehensive Plan. BMP's (Best <br />Management Practices) cannot be used here to satisfy watershed requirements. <br />A 150' Duke Power transmission easement crosses the extreme northerly end of Lot 3. A <br />Type D 50' land use buffer runs along the southern edge of the power easement. <br />Except for the power easement, the entire tract is wooded with mature hardwoods and <br />locally common understory species. The Division of Environmental Health and the soils <br />survey show that the soils are suitable to support septic systems. The subject property <br />ranges in height from 700' to 780' above MSL sloping to the southwest and north and <br />typically running in the Th to 15 percent slope range. <br />Lots will be served by individual wells and septic systems. <br />Private roads are justified because the proposal maintains rural character by providing <br />larger lots and building setbacks than required in the R -1 zoning district, by prohibiting <br />further subdivision, by limiting tree removal, and by minimizing disturbance and grading. <br />The area is designated as Rural Residential in the adopted Land Use Element of the <br />Comprehensive Plan. This property and surrounding parcels are zoned R -1 Rural <br />Residential. Land uses are single - family residential. <br />The Orange County Fire Marshal and EMS indicate that the subdivision can be served <br />adequately by their respective agencies. <br />� The final plat of the `first phase' of High Point Woods was approved as a minor <br />subdivision by Planning Staff on November 26, 1996. <br />The next activity required major subdivision approval by the Planning Board <br />and County Commissioners because it was submitted prior to the expiration of <br />two years after the approval of the minor subdivision of the property. Titled LQJ <br />4A High Point Woods Subdivision, this `second phase' consisted of the <br />subdivision of Lot 4A into two lots fronting on the south side of Davis Road. <br />Final plat approval-by the Board of County Commissioners was on August 4, <br />1997. <br />-'r The Planning Board unanimously approved a major subdivision Concept Plan <br />on August 5, 1998, and a Preliminary Plan on January 6, 1999, for High Point <br />Woods, Phase III. <br />
