13 <br />Mr. Gledhill stated "Mr. Chairman, I would like to clarify just <br />what we have reviewed. We have reviewed only the cover sheet of that <br />contract. I would suggest that if the Soard is inclined to take action <br />on Mr. Nassif's proposal, that it do so subject to the Attorney's <br />approval as to proper legal form." <br />Commissioner Pinney asked the County Attorney. "You don't have <br />the actual contract?" <br />Commissioner Gustaveson stated "that s assumed that before the <br />signing of the formal contract, the Attorney reviews it." <br />Mr. Nassif reminded the Chairman that on the back of the contract <br />was Mrs. Flora Garrett's signature, and that would have to be changed, <br />"since it was prepared for that evening, when you requested." <br />Commissioner Gustaveson stated that the implementation of his <br />motion would require that the Attorney meet with Mr. Nassif to prepare <br />an up-to-date cantract~and that they review it before the Chairman signs <br />it. <br />Commissioner Walker stated, "one other thing which we will never <br />know is if there is capable people that might be willing to do it cheaper <br />or at least have the opportunity to say they're going to bid higher or <br />bid the same. We're not giving other firms the same opportunity as we <br />are giving Mr. Nassif. I certainly don't see why. T don't have anything <br />against Mr. Nassif. It's just the action of this Board and I think it <br />should be spread upon the minutes and the pages of the news, the way <br />this Soard has acted in this matter. I would ask that this be tabled <br />until at least we have a change to look at the contract. To my knowledge, <br />no member of this Board has ever looked at the contract except the coveb <br />sheet." <br />Commissioner Gustaveson stated that the implementation of'tiis <br />motion was to have the Attorney review the contract. <br />Commissioner Walker asked, "after we have already approved it?" <br />Commissioner Gustaveson replied, "after we have approved negotia- <br />tion with Mr. Nassif, yes." <br />Commissioner Walker stated, "I haven't had any negotiatien with <br />Mr. Nassif, that's my problem. Had I been included in these negotia- <br />tion, maybe I wouldn't be so sore about it." <br />Commissioner Gustaveson stated that had Mr. Walker been at the <br />meeting'in Carrboro, he would have been involved in the discussion. <br />Mr. Walker stated, "at that particular .meeting, I.couldn't be <br />there, Norm. Richard said that it wasn't discussed, that it was called <br />off." <br />Commissioner Whitted replied, "no, the meeting in Carrboro was <br />where we instructed Mr. Nassif to present us with a contract on the <br />16th. The 16th was when the Board got into the other....there was a <br />motion on the floor to enter into the contract at that time, and it <br />was .tabled until Mrs. Johnson went through the minutes and that's where <br />we were and that's how we got to where we are now. We had discussions <br />with Mr. Nassif at the Carrboro Town Hall which was a regular meeting of <br />this Board. It was a public meeting." <br />Commissioner Walker answered, "right, and I read those minutes and <br />I don't remember anything about that." <br />___ Commissioner Whitted replied, "minutes don't reflect verbatim dis-- <br />cussion, but we did have a discussion with Mr. Nassif." <br />Commissioner Gustaveson added, "a good number of questions were <br />raised at that time regarding financing and scheduling." <br />Commissioner Whitted asked Mr. Walker if he was making a motion to <br />table this matter. <br />Commissioner Walker replied, "yes." <br />The Chairman repeated the motion to table the matter. He asked if <br />there was a second to the motion. He then declared that the motion died <br />
