45 <br />preserve such easement area (including without limitation his septic lines, drain fields and all other <br />aspects of his septic system) to this standard, then the Association shall have the right to maintain, <br />repair and preserve such easement area (including without limitation the septic lines, drain fields <br />and all other aspects of his septic system solely at the expense of such Lot Owner and all such <br />expense shall become a special assessment and lien enforceable against such Lot in the same <br />manner as set forth in Article IV of this Declaration for all other assessments, <br />r;`.4090 ullI <br />USE RESTRICTIONS <br />Section-L Rules and ReJnflons; The Board of Directors of the Association shall have the <br />power to formulate, publish and enforce reasonable rules and regulations concerning the use and <br />enjoyment of the yard space of each Lot. <br />Section 2z, Use of EmpcMr. No Lot shall be used except for single-family residential purposes <br />in accordance with the. Resolution of Approval issued by Orange County and in accordance with <br />the restrictions hereinafter set forth. "Single - family residential" purposes may include "light <br />housekeeping" apartments containing no more than one bedroom. <br />(a) There shall be no further subdivision of any Lot shown on any recorded plat <br />of WOODGREEN SUBDIVISION. <br />(b) No building or structure of any nature or kind shall be located on any Lot <br />(1) within the Open Space Area and .(2) where a front, side or rear property line is not <br />adjacent to the Buffer Area, nearer to the front property Lot line than forty (40) feet, <br />nearer to a side street line for a corner lot than forty (40) feet, nearer to any side property <br />Lot line than twenty (20) feet nor nearer to any rear property Lot line than forty (40) feet. <br />Abutting chimneys, and overhanging eaves, gutters or roof lines are exempt from the <br />building setback limitations set forth in (2) above, but not from the Open Space Area <br />limitation set forth in (1) above. No buildings or other structures of any kind, other than <br />the crossing of a sidewalk or entrance driveway shall be allowed in these areas. Relief <br />from any violation of the setback violations set forth in (2) above may be granted by the <br />Declarant at its sole discretion provided that compliance with the zoning ordinances of <br />Orange County is maintained and provided that` such relief or waives is in writing and <br />recorded in -the Orange County Registry. <br />(c) All dwellings shall be constructed on the Lot by a building contractor <br />licensed in the State of North Carolina. No dwelling shall be erected or allowed to remain <br />on any Lot unless such dwelling shall contain at least 1,800 square feet of heated, finished <br />living area. No dwelling shall exceed three stories in height No garage constructed along <br />with a dwelling on any Lot shall exceed the size of a three (3) car garage..
