<br />J <br />2 <br />Surrounding lands aze in pasture and single-family residential use. Adjoining pazcels are <br />zoned AR Agricultural-Residential. <br />Entrance to the proposed subdivision is shown as being on the north side of Thom Road <br />(SR 2145)Bradshaw Quarry Road (SR 1100) via Acorn Knoll Drive-a 900'f cul-de-sac <br />with a proposed 50' public right-of--way and an 18' public travelway. The Acorn Knoll <br />Drive entrance is 350' west of Mebane Oaks Road. All nine lots shall be accessed from <br />Acorn Knoll Drive. No stub-out is recommended for the proposed subdivision. Lands to <br />the north aze proposed to be reserved permanently as a common conservation azea. <br />The Concept Plan was offered by Planning Staff for consideration to the Planning Boazd <br />on May 7, 1998. A quorum was not present. (See attached 5-7-98 Planning Boazd <br />Minutes). Section III-D-2-c Plannine Boazd Review and Approval Procedures states: <br />The Planning Board shall take action within forty-five (4S) <br />days of the meeting at which the Planning Department's report <br />is submitted to it or within such further time consented to in <br />writing by the applicant. If the Planning Board fails to take <br />action within the specified time period, or extension thereof, <br />the Planning Board shall be deemed to recommend approval of <br />the Concept Plan without conditions. <br />Following the flexible development option as presented in Section IV-B-10 of the <br />Subdivision Regulations, 6.56a or 40% of the subdivision is proposed as openspace <br />which will be reserved in the form of conservation easements or restrictive covenants. <br />These tracts will be owned by the Homeowners Association. The purpose is to establish <br />and preserve visual vegetative buffers, in addition to those buffers (30') required along <br />Mebane Oaks and Bradshaw Quarry Roads as designated collectors in the Transportation <br />Element of the Comprehensive Plan. To the immediate north of Lots 5 & 6, a 5.89a <br />conservation azea is reserved as common space. This azea would be available for <br />recreational use by residents. <br />Planning Board Recommendation <br />The Planning Board unanimously recommends adoption of the Preliminary Plan for <br />Village of the Oaks, Section Five, to the Boazd of County Commissioners with the <br />conditions listed in the proposed attached Resolution of the Orange County Board of <br />Commissioners. Please see attached Planning Boazd minutes for February 3, 1999. <br />RECONIlVIENDATION: <br />The Administration recommends approval of the Preliminary Plan for Village of the <br />Oaks, Section Five, with the conditions listed in the Resolution of Approval. <br />
