1 (31 Minor intermittent streams as shown on the Northern Transition Area <br />2 Stream Buffer Map. Measure along a line running perpendicular to and <br />3 thirty (30) feet from the center of the minor intermittent stream. <br />4 (d) Subject to subsection (e), the existing natural vegetation in a buffer area designated <br />5 in accordance with this section shall not be disturbed in any way that would reduce <br />6 the buffer area's effectiveness in achieving the objectives set forth in subsection (a). <br />7 In addition, buffer areas from which the vegetative cover does not exist, has been <br />8 removed, or is inadequate shall be planted or otherwise provided with vegetative <br />9 cover or devices, sufficient to allow the buffer area to accomplish the objectives set <br />10 forth in subsection <br />11 <br />12 (e) Notwithstanding the foregoing provisions, the permit issuing authority may <br />13 authorize the crossing of a designated buffer area by a street, bikeway, sidewalk, <br />14 water or sewer line or pump station under the circumstances specified in Subsection <br />15 15- 184(8). In addition, the permit issuing authority may authorize sewer lines to be <br />16 constructed within buffer areas designated under this section under circumstances <br />17 where such location is practicably unavoidable if the subject property is to be <br />18 served under the provisions of Section 15- 238(c) and an alternate design would <br />19 result in greater damage to the environment, so long as such sewer line is located to <br />20 the extent practicable at least twenty -five feet from the edge of any stream bank. <br />21 <br />22 <br />23 <br />24 SECTION 20. Subsection 316(c) is deleted and the following subsection (c) is inserted in lieu <br />25 thereof: <br />26 <br />27 (c) There shall be no clearcutting in any development within the Transition Area portion <br />28 of the Carrboro Joint Development Area as identified in the Joint Planning Agreement. The term <br />29 " clearcutting" shall refer to the large - scale, indiscriminate removal of trees, shrubs, and undergrowth <br />30 with the intention of preparing real property for nonagricultural purposes. <br />31 <br />32 SECTION 21. Article = is amended by adding a new Section 15 -312 to read as follows: <br />33 <br />34 Section 15 -312 Protective Buffer Along Major Roads <br />35 <br />36 Notwithstanding the provisions of Section 15 -308, an undisturbed protective buffer shall be <br />37 maintained along Old N.C. 86, Daiuyland Road, Union Grove Church Road, Homestead Road, Eubanks <br />38 Road and Smith Level Road south of Ray Road that will help preserve the scenic views and elements of this <br />39 area. This buffer shall be established by measuring along a line perpendicular to the right -of -way of these <br />40 roads one hundred (100) feet. If the buffer area does not provide the equivalent of a Type `A' screen, the <br />41 developer shall provide a Type `A' screen on the development's side of the buffer (one hundred (100) feet <br />42 from the right -of -way). <br />43 <br />44 SECTION 22.
