Pi <br />- Executive Summary - <br />County Commissioner Review of Proposed Ordinance Amendments for Implementation of <br />the Facilitated Small Area Plan for Carrboro's Northern Study Area <br />Proposed amendments to the Joint Planning Area (JPA) Land Use Plan and Map and the Joint <br />Planning Agreement to incorporate the Facilitated Small Area Plan for Carrboro's Northern <br />Study Area were presented at the April 8, 1998 JPA Public Hearing. Following a series of <br />advisory and governing board reviews during the remainder of 1998 and early 1999, amendments <br />to the JPA Land Use Plan and Map and Joint Planning Agreement were adopted by the Board of <br />County Commissioners on February 2, 1999. These amendments were subsequently referred to <br />the Towns of Chapel Hill and Carrboro and both jurisdictions have adopted the amendments. <br />Key features of the adopted amendments are that the density limitations of Carrboro Transition <br />Area II (one unit per acre until development in Transition Area I reaches 75 %) do not apply to <br />Village Mixed Use and Office /Assembly "floating" conditional use districts; and creation of such <br />districts requires the approval of hob Orange County and Carrboro following a joint public <br />hearing by the two governing bodies. <br />Concurrent with the preparation and adoption of the Facilitated Small Area Plan, an ordinance <br />drafting committee prepared proposed amendments to the Carrboro Land Use Ordinance for <br />implementation of the small area plan. Carrboro will present the ordinance amendments at a <br />town public hearing on March 23, 1999. Section 2.6C of the Joint Planning Agreement requires <br />that "Whenever Chapel Hill proposes to amend the text of its Land Development Ordinance, and <br />whenever Carrboro proposes to amend the text of its Land Use Ordinance, the respective towns <br />shall deliver a copy of the full text of the proposed amendment to Orange County not later than <br />thirty (30) days before the date of the public hearing on any such amendment." The proposed <br />ordinance amendments were received by County staff on February 22, 1999, and subsequently <br />mailed to the Board of Commissioners for review. <br />The proposed ordinance amendments consist of 27 re, isions or additions to the existing <br />ordinance. The sections cover density calculations, open space requirements, mitigating impacts <br />of non - residential uses, environmental protection, affordable housing, advisory board <br />representation from the Northern Transition Area, and site planning procedures. Section 2.lC of <br />the Joint Planning Agreement requires Orange County to adopt by reference "the Carrboro Land <br />Use Ordinance and make its provisions applicable to that portion of the Transition area within <br />the CJDA" ( Carrboro Joint Development Review Area). Section 2.6C of the Joint Planning <br />Agreement requires that any objection by Orange County to a land use ordinance amendment <br />"...shall be based on a determination by Orange Count. that the proposed amendment is <br />inconsistent with the adopted Joint Planning Area Land Use Plan." <br />The March 16 meeting will be an opportunity for the Board of Commissioners to review the <br />proposed amendments and ask questions of Carrboro staff. A joint meeting of the County <br />Commissioners and Carrboro Board of Aldermen at the Southern Human Services Center on <br />March 30 will provide time for a more in -depth discussion on the proposed amendments. <br />
