11 <br />Dixon to Kirk <br />December 18,1498 <br />Page 2 <br />d) Tree Protection Setbacks Although the preliminary plan indicates that the development <br />will provide a minimum of a ten foot tree protection area on the back of all lots, SASS <br />Properties has agreed to establish afifty-foot undisturbed buffer on the rear of all lots <br />located along the common boundary with the open space area that TLC is to purchase. <br />As expressed above in a), I understand that Kimley-Horn has already, discussed this <br />oversight in the preliminary plan with you and that they intend to make this correction in <br />'the final plat. In the purchase contract with TLC, SASS Properties. has also agreed to <br />include in the covenants of the neighborhood association that owners of individual lots <br />will be required to erect plastic fencing to protect the trees within this fifty-foot buffer <br />during any construction and installation of houses or other improvements on the lots. <br />TT~C has continued to be impressed by SASS Properties's willingness to work with us to <br />protect this important area.
