39 <br />l_4y�� <br />DEFINMONS <br />Section 1! "Association• small mean and refer to WOODGREEN SUBDIVISION <br />HOMMWNW ASSOCIATION, an unincorporated association, its successors and assigns. The <br />Association will be administered in accordance with the provisions of this Declaration and the <br />Bylaws contained herein and shall be domed to have been created and established on the date that <br />this Declaration is recorded. <br />Section 26 "PROPERTY" shall mean and refer to that certain real property, as more <br />particularly described on Exhibit A attached hereto and incorporated herein by reference. <br />Sec inn I! "The Open Space Area" shall mean those portions of the -Lots so designated as <br />"Open Space Buffet", as "Open Space and Flood Plain" and as "Open Space and Stream Buffer", <br />including without limitation the area designated as Tract 1 -A and 2 -A (which are also the septic <br />drain fields for Lot No. 1 and Lot No. 2, respectively) on the plat and survey of WOODGREEN <br />SUBDIVISION, as recorded in Plat Book , at Page , Orange County Registry, <br />to which plat reference is hereby made for a more particular description of same, which such <br />Open Space Area shall be subject to the applicable Orange County Zoning and Subdivision <br />regulations. <br />Section 4: "Lot" shall mean and.refer to any plot of land shown upon the recorded subdivision <br />plat of the PROPERTY with the exception of the road right -of -ways. <br />Section 5: "Owner' shall mean and refer to the record owner, whether one or more persons <br />or entities, of the fee simple title to any Lot. "Owner" shall not include those who have an <br />interest in the Lot merely as security for the performance of an obligation. Each Owner shall be <br />a member of the Association. <br />Section 6: " Declarant" shall refer to the undersigned, its successors and assigns. <br />Section 7. "Declaration" shall mean and refer to this instrument as executed, made applicable <br />to the " PROPERTY" and recorded in the Office of the Register of Deeds of Orange County. <br />Rcdon g. " Member" shall mean and refer to those persons entitled to membership in the <br />Association as provided in this Declaration. <br />—2— <br />
