Calvin Horton, Chapel Hill Town Manager <br />SUBJECT: Setting Fees for the Orange Regional Landfill <br />DATE: February 22, 1999 <br />6C~MC~ <br />FEB 2 6 1999 D <br />I understand that the Landfill Owners Group received an oral petition at its February 11 <br />meeting from the Eno River Association. The Association requested that the tipping fees <br />be waived for the solid waste that it would deliver to the landfill during its volunteer <br />clean-up of a tract recently acquired to become part of the Eno River Park. The <br />Association intended for the clean-up to begin on February 15. The Landfill Owners <br />Group acted favorably on the petition that same evening. <br />I can understand that the timing of this request put pressure on the Landfill Owners <br />Group for an immediate decision. However, it is my duty to remind you that the 1972 <br />Agreement among the Town of Chapel Hill, the Town of Carrboro and Orange County <br />states that "A fee schedule approved by all the Parties shall be adopted." The annual <br />review of tipping fees normally includes the recommendations of the Landfill Owners <br />Group and the subsequent action of each of the governing bodies. Changes aze made to <br />the current tipping fee schedule only upon the approval of all three of the owners. <br />Previous requests for fee waivers have been dealt with in the same way <br />Thank you for your consideration of this procedural issue. <br />
