STATE OF NORTH CAROLINA HUMAN SERVICE AND CAPITAL <br />COUNTY OF WAKE GRANT AGREEMENT FOR <br />PUBLIC BODY ORGANIZATIONS <br />(FOR COMMUNITY TRANSPORTATION <br />NORTH CAROLINA SYSTEMS OPERATING IN URBAN COUNTIES) <br />DEPARTMENT OF TRANSPORTATION <br />DOT PROGRAM NUMBER: DOT-03 & DOT-14 <br />and <br />PROJECT NUMBER: 09-US-056 <br />09-SC-056 <br />ORANGE COUNTY <br />WBS ELEMENT(S): 36221.19.7.1 <br />36226.77.6.3 <br />THIS AGREEMENT made this the _day of , 20_, (hereinafter referred to as <br />AGREEMENT) by and between the DEPARTMENT OF TRANSPORTATION (hereinafter <br />referred to as "Department", an agency of the State of North Carolina) and ORANGE COUNTY <br />(acting in its capacity as the designated recipient of Human Service Transportation <br />Management and Capital program funds, hereinafter referred to as the "Contractor"). <br />WHEREAS, Article 2B of Chapter 136 of the North Carolina General Statutes <br />designated the Department of Transportation as the agency of the State of North Carolina <br />responsible for administering funding assistance for public transportation in rural and small <br />urban areas by way of a formula grant program to be administered by the State; and <br />WHEREAS, the purposes of Article 2B of .Chapter 136 are to enhance access of people <br />in nonurbanized areas for purposes such as health care, shopping, education, recreation, <br />public services, and employment by encouraging the maintenance, development, <br />improvement, and use of passenger transportation systems; and <br />WHEREAS, the Contractor has been designated as the recipient of Human Service <br />Transportation Management and Capital (for Community Transportation Systems operating in <br />urban counties) funds, and <br />WHEREAS, Article 26 of Chapter 136 of the North Carolina General Statutes <br />designated the Department of Transportation as the agency of the State of North Carolina <br />responsible for administering all Federal and/or state programs relating to public transportation, <br />and granted the Department authority to do all things required under applicable Federal and/or <br />State legislation to properly administer the public transportation within the State of North <br />Carolina; and <br />WHEREAS, in order to assist in providing transportation services, the Department, under <br />the terms of this Agreement shall make grants of administrative assistance to the Contractor; <br />and . <br />WHEREAS, the Department and the Contractor desire to secure and utilize Human <br />Service Transportation Management and capital (for Community Transportation Systems <br />operating in urban counties) grant funds for the above referenced purposes. <br />NOW, THEREFORE, in consideration of the mutual covenants herein set forth, the <br />Department and the Contractor agree as follows: <br />Section 1. Purpose of Agreement. The purpose of this Agreement is to provide for the <br />undertaking of nonurbanized area public transportation services as described in the project <br />application (hereinafter referred tows "Project") properly prepared, endorsed, approved, and <br />
