UCS Concerns about Harris Spent Fuel Pool Plans <br />Potential Conflict with NRC's Waste Confidence Decisions <br />On page 1 of Enclosure 1 to Serial: I-INP-98-188, "Basis for Change Request," CP&L stated: <br />CP&L has implemented a spent fuel shipping program because DOE spent fuel storage <br />facilities are not available and are not expected to be available for the foreseeable future. <br />In SECY-89-176 dated June 8, 1989, the NR.C staff recommended that the NRC Commissioners <br />approve revisions to the Waste Confidence Decision that had been issued in August 1984. The <br />NRC addressed the storage of spent fuel. at reactor sites in this decision. One of the <br />recommendations made by the NRC staff was to change the estimated availability date for a <br />federal repository for spent fuel from 2007-2009 to sometime in the first quarter of the 21S` <br />century. In August 1990, the NRC Commissioners approved this change and issued the updated <br />Waste Confidence Decision. <br />Because the duration of CP&L's `foreseeable future' is not specified, it may conflict with the <br />NRC's Waste Confidence Decision if it extends beyond the year 2025. CP&L's statement implies <br />a lack of confidence in DOE's ability to make a spent fuel storage facility available. If this <br />implication is valid, it would seem imprudent for CP&L to seek an ability to generate more spent <br />fuel. <br />04/05/99 Page 4 <br />
