4so <br />Chairman Garrett stated that she would like to defer this <br />appointment until the first Tuedsay's Meeting (July 6, 1976) in <br />July. <br />The Chairman referred to Item 2V: Resolution authorizing <br />Orange County's Sediment Control Officer to administer the Orange <br />County Sediment Control Ordinance within the corporate limits of <br />the Town of Chapel Hill. <br />(For Copy of Resolution, See Docket Sook Nine, Page 618 )• <br />Upon motion of Commissioner Gustaveson, seconded by Com- <br />missioner Pinney, it was moved and unanimously adopted to approve <br />the resolution authorizing Orange Ca~nty's Sediment Control Officer <br />to administer the Sedimenti Control Ordinance within the corporate <br />limits of the Town of Chapel Hill. <br />The Chairman referred to Item V: Preliminary Resolution <br />to establish a Paving Assessment Program for State Roads #1711, <br />1$31, 1$32 and 1833. Geoffery Gledhill will present and review <br />this resolution. <br />Mr. Gledhill reviewed for the Board and residents of the <br />stated roads the General Statutes procedures of special assessment <br />for the paving of roads. He pointed out that all property owners <br />must be assessed, however, they may pay the amount in full within <br />thirty days at no interest charge. He stated that someone must be <br />directed to prepare an assessment roll prior to the public hearing. <br />Discussion essued regarding 'the amount per linear foot <br />of road frontage required to be paid by the property owners. The <br />Board requested that particular number of dollars per linear foot <br />be omitted from the document. <br />Dicussion ensued and Mr. Gledhill continued to review with <br />the Hoard the technical aspects of the document. <br />Mr. Gene Conti, a resident of the area, stated that he was <br />the one of the larger land owners and it would be easier to be <br />assessed over a ten year period rather than a five year period, and <br />that it would be a hardship for him to be required to repay his <br />assessment within five years. <br />Commissioner Gustaveson stated that this would be a resol- <br />ving fund set up by the Coun~y and that five years would keep the <br />monies flowing rather than over a ten year period. <br />Mr. Gledhill stated that this legal opinion was that the <br />same pay back period should be used for each property owner in <br />each project undertaken. <br />Mr. Conti inquired if it would be possible to change the <br />pay back period from five years to ten years at some later date. <br />Mr. Gledhill stated that legally this could be changes. <br />Commissioner Garrett stated that she and other property <br />owners understood Mr. Conti's situation and that there might be <br />some arrangemnets that could be made with the other property <br />owners. <br />Upon motion of Commissioner Gustaveson, seconded by Com- <br />missioner Walker, it was moved and unanimously adopted~to approve <br />the Preliminary Assessment Resolution for the Financing by Orange <br />County of the. Local Share of the cost of Paviny North Carolina State <br />Roads Numbers 1711, l$3l, 1832, and 1833 located in Eno Township, <br />Orange, County, North Carolina, as amedded by Mr. Gledhill. <br />(See Minute Docket Book Nine, Page6~pfor copy of Resolution.) <br />July 6, 1976, at 10:00 a.m. was scheduled for the public <br />hearing on the matter. <br />Commissioner Garrett referred to Item VI: The Finance <br />Director will present amendments to the current County Budget. <br />
