3-i- v7 <br />~~ z <br />STATE OF NORTH CAROLINA AGREEMENT FOR CONSTRUCTION <br />THE COUNTY OF ORANGE SERVICES <br />This Agreement made and entered into by and between the County of Orange, on behalf of its <br />Solid Waste Department, herein referred to as "County" and Jerry W. McCullock, 1415 <br />McCullock Loop Rd., Hurdle Mills, NC., 27541, herein referred to as "Contractor". <br />WHEREAS, the County wishes to contract with the Contractor for the construction of the <br />expansion of the Solid Waste Collection Center at 3605 Walnut Grove Church Road, <br />Hillsborough, NC, and <br />WHEREAS, the Contractor wishes to provide these services. <br />NOW THEREFORE, it is mutually agreed as follows: <br />1. TERM: This Agreement, unless amended as provided herein, shall be in effect from <br />the date of the execution of this agreement, until May 4, 2007. The work shall be <br />_ .....substantially completed on or before A_ pri124, 200.7 and_ completed and ready for final <br />payment on or before May 4, 2007. <br />2. DUTIES OF CONTRACTOR: The Contractor shall construct the Solid Waste <br />Collection Center in accordance with the attached Plans and Specifications contained <br />• in ORANGE COUNTY BID NO. 1449. <br />3. DUTIES OF COUNTY: The County shall pay the Contractor for completion of the <br />Work a total amount not to exceed a lump sum payment of $197,387.05 for the <br />services as set forth in the attached plans and specifications. <br />4. BILLING AND PAYMENT: The Contractor shall submit an Application for Payment <br />on a monthly basis. The Contractor shall submit a Certificate of Final Payment. <br />5. CHANGES IN THE WORK: Agreement may be amended only in writing by mutual <br />agreement by the County and the Contractor. <br />6. INSURANCE PROVISIONS: The Contractor shall have the following insurance <br />coverage: <br />• Worker's Compensation -Coverage to apply for all employees for statutory <br />limits in compliance with the applicable state and federal laws. The policy <br />must include employer's liability with a limit of $100,000 for each accident, <br />$100,000 bodily injury by disease each employee and $500,000 bodily injury <br />by disease policy limit. <br />• Comprehensive General Liability -Shall have minimum limits of $1,000,000 <br />per occurrence combined single limit for bodily injury liability and property <br />damage liability. This shall include premises and/or operations, independent <br />• contractors, products and/or underground damage coverage, sudden and <br />accidental pollution losses, and a contractual liability endorsement. <br />
