~zs <br />MINUTES OF THE ORANGE COUNTY BOARD OF COMMISSIONERS <br />Tuesday, May 18, 1976 <br />The Orange County Soard of Commissioners met in regular session <br />on Tuesday, May 18, 197b, at 7:30 p.m. in the Commissioners Room of <br />the.'Courthause. <br />Members present were Chairman Flora Garrett, Commissioners <br />Norman Gustaveson, Jan Pinney, Norman Walker and Richard Whitted. <br />Members absent were none. <br />Others present were S. M. Gattis, County Administrator; Neal <br />Evans, Fiscal Officer; A. B. Coleman, Jr., County Attorney; and <br />Agatha Johnson, Acting ,Clerk. <br />Since there was such a large crowd present, it was suggested <br />that the first portion of the meeting be conducted in the Superior <br />Courtroom. The meeting was adjourned to the Superior Courtroom. <br />Chairman Garrett referred to Item XI - Discussion of partici- <br />pating paving programs. Interested property owners and represen- <br />tatives of the Department of Transportation were present. <br />Mr. Bennie Haswell of Colonial Hill Extension was spokesman for <br />the citizens present and he presented to Mr. S. H. Jones, of the State <br />Department of Transportation, and to the Chairman, petitions showing <br />87 signatures of property owners along State Roads #).831, 1832, 1833, <br />and 1711. <br />The Chairman asked Mr. Jones to explain the .asssessment program <br />to the citizens. Mr. Jones stated that the cost of paving the road <br />was $9.00 per linear foot, however, the State pays $5.00 of this cost <br />and the participating owners must pay $4.00 per linear foot. Mr. <br />Jones stated that the total money far paving the road must be inhand <br />before work is started and that 75% of property owners must agree <br />to the owner participation program. Mr. Jones stated that his Depart- <br />ment received a formal written request from the res~lents stating the <br />beginning and ending points of proposed construction. <br />Mr. Coleman, County Attorney, read from General Statutes 153A-1$5 <br />Special Assessments and 153A-205 Supplement which stated that the County <br />could finance the local share of the cost of paving the road and that <br />citizens could be assessed for this cost. Mr. Coleman explained that <br />the first step for the Commissioners is to adopt a preliminary assess- <br />ment resolution and 10 days thereafter, a notice of public hearing must <br />be made. At the Public Hearing, the Soard of Commissioners shall hear <br />all interested persons who appear with respect to any matter covered <br />by the preliminary Assessemnt..Resolution. After the Public Hearing, the <br />Board should adapt a Final Assessment Resolution which shall describe <br />the project in general terms. (G.S. 153A-192). When a project is com- <br />pleted, the Board of Commissioners shall determine the project's total <br />cost. When the cost is determined, a preliminary assessment roll is pre- <br />pared and filed in the Clerk's Office for public inspection. Mr. Coleman <br />stated that within 30 days from the confirmation of the assessment roll, <br />the property owner could pay his assessment without paying the 8% interest <br />rate. The first installment with interest is due on the date when pro- <br />perty taxes are due, and one installment with interest is due on the same <br />date in each successive year until the as~:essment is paid in full. Mr. <br />Coleman stated further that the assessment would be paid in 10 annual <br />payments. <br />A question and answer period ensued between residents, the County <br />Board of Commissioners and Mr. Jones. <br />Commissioner Gustaveson moved that the Board of Commissioners <br />adopt this assessment program to help residents in the paving of their <br />roads. Commissioner Pinney seconded this motion. <br />Further discussion ensued. <br />Commissioner Whitted called for the question. <br />
