ORANGE COUNTY
BOARD OF COMMISSIONERS
ACTION AGENDA ITEM ABSTRACT
Meeting Date: June 16, 2009
Action Agenda
Item No. ~ -1-a
SUBJECT: Orange County Housing Authority Bylaws Revision and Board Member
Resignations
DEPARTMENT: Housing/Community Dev. PUBLIC HEARING: (Y/N) No
ATTACHMENT(S):
Bylaws Revision INFORMATION CONTACT:
Tara L. Fikes, (919) 245- 2490
PURPOSE: To consider the following actions related to the Orange County Housing Authority:
1) Approval of revisions to the Bylaws of the Orange County Housing Authority; and
2) Resignation as the Board of Commissioners of the Orange County Housing Authority.
BACKGROUND: On March 18, 2008 the Board of County Commissioners approved revisions
to the Bylaws of the Orange County Housing Authority in order to reflect current state statutes
and current operations. The Board approved the attached Bylaws.
Since adoption, former County Attorney Geof Gledhill suggested an additional change in the
Bylaws to change the language regarding the term of board members to language that ensures
compliance with state statutes into the future. That language is blacklined in the attached
Bylaws.
According to the revised Bylaws, the Orange County Board of Commissioners appoint all
members of the Housing Authority Board with one member who is directly assisted by the
Authority and one member who is the Executive Director of the Authority. In order to
accomplish this, the current Board of County Commissioners must resign as the Housing
Authority board members and appoint new members.
FINANCIAL IMPACT: No immediate impacts.
RECOMMENDATION (S): The Manager recommends the Board:
1) Approve the proposed revision to the Bylaws of the Orange County Housing Authority;
and
2) Resign as the Board of Commissioners of the Orange County Housing Authority.
