License Agreement: Future Northeast District Park BOCC draft 8 <br />SECTION THIRTEEN <br />NO LANDLORD-TENANT RELATIONSHIP OR PROPERTY INTEREST <br />It is expressly agreed and understood that this Agreement shall not operate or be <br />construed to create the relationship of landlord and tenant between Licensor and Licensee <br />whatsoever. <br />Licensee expressly agrees that they do not and shall not claim at any time any interest <br />or estate of any kind or extent whatsoever in the Property, by virtue of the rights granted <br />under this Agreement or Licensee's occupancy or use under this Agreement. Licensee <br />expressly agrees and understands that Licensor shall have the free and continual right to <br />enter, inspect and occupy the Property at any time during the term of this Agreement subject <br />to the terms hereof. Nothing contained herein shall require Licensor to obtain permission or <br />notify Licensee prior to entering the Property. <br />SECTION FOURTEEN <br />MISCELLANEOUS <br />It is agreed that this Agreement shall be governed by, construed, and enforced in <br />accordance with the laws of the State of North Carolina. <br />This Agreement shall constitute the entire Agreement between the parties and any <br />prior understanding or representation of any kind preceding the date of this Agreement shall <br />not be binding upon either party except to the extent incorporated in this Agreement. <br />Any modification of this Agreement or additional obligation assumed by either party <br />in connection with this Agreement shall be binding only if evidenced in writing signed by <br />each party or an authorized representative of each party. <br />Any notice provided for or concerning this Agreement shall be in writing and shall be <br />deemed sufficiently given when sent by certified or registered mail if sent to the respective <br />address of each party as set forth at the beginning of this Agreement. <br />Licensee's privileges under this Agreement shall not be assignable by Licensee in <br />whole or in part. <br />[The remainder of this page is intentionally left blank.
