• <br />C <br />• <br />OPC Area Program Policy and Procedure <br />Subject: Conflict of interest -staff <br />Area Board Approval: May 2000 <br />Policy Manual: Administrative Revision Date: <br />Policy: OPC prohibits the solicitation of clients to staffmembers' private practices. <br />OPC employees may not enter into contracts or business transactions on behalf of OPC <br />from which they may benefit personally. <br />Purpose: To avoid any conflict of interest in referrals of clients outside OPC and to <br />ensure that employees, in the conduct of business on behalf of OPC, are not in situations <br />in which the interest of the OPC would be in conflict with their own fmancial or personal <br />interest. <br />Procedures: <br />Regarding referrals of patients to employees' private practices: <br />If an individual requests referral information from OPC, he/she will not be directed solely <br />to any current or former OPC employees unless they are the only providers meeting the <br />individual's need in that area. Names of current or former employees maybe given to <br />the individual, when their skills are appropriate, along with the names of other providers <br />with no current or past association with OPC. The goal of offering names of providers <br />must be to give the individual an opportunity to choose freely from appropriate providers. <br />If an OPC employee is leaving OPC to begin a private practice, he/she must inform any <br />current clients that OPC will continue to provide caze. The departing employee may not <br />solicit or encourage the client to follow him/her to the private practice. If the client <br />initiates a request to follow the departing employee, the employee must inform his/her <br />supervisor of the client's request. If the supervisor feels that the situation needs further <br />discussion, the supervisor may contact the client to arrange a meeting to discuss the <br />options for caze available. <br />Regarding business contracts from which employees may benefit personally: <br />Employees will not contract for goods or services with a business or organization in <br />which the employee has a personal or financial interest. Similazly, employees will not <br />purchase goods or services from him-/herself or from other persons, groups, or <br />organizations in which the employee has a personal or financial interest. <br />Employees will not attempt to influence other employees to enter into any contract or <br />undertake any financial transaction on behalf of the agency from which the first <br />employee would benefit either personally or financially. <br />See also Dual Employment Policy in Human Resources Manual. <br />A-36 <br />
