Commissioner Gustaveson seconded the motion. <br />The Chairman called for the vote on the motion. <br />Commissioners Pinney and Walker voted. nay. <br />Commissioners Garrett, Gustaveson, and Whitted voted aye. <br />Chairman Garrett then declared the motion passed. <br />Commissioner Walker then moved that when the next Ordinance is <br />prepared that a Public Hearing to consider the proposal be conducted. <br />Commissioner Finney seconded this motion. <br />Chairman Garrett called far the vote on the motion. <br />Commissioners Pinney and Walker voted aye. <br />Commissioners Garrett, Gustaveson, and Whitted voted nay. <br />Chairman Garrett then declared the motion defeated. <br />The Chairman referred to Item III-B: An agreement Regulating the <br />Sale of Lots in Robins Wood Development. <br />The County Attorney presented to the Board of Commissioners his <br />report on a proposed contract between Orange County and Lexington <br />Homes, the Developers of Robins Wood Subdivision. <br />Jeff Gladhill, representing the County Attorney, advised the <br />Board of Commissioners that under this Gantract the County would <br />have the same enforcement powers to prohibit sale of lots in Robins <br />Wood Development it would have, had the subdivision plat of Robins <br />Wood not been recorded. <br />commissioner Whitted inquired if the County has authority to <br />accept a Contract restricting the sale of lots in Robins tload pending <br />completion of the road system there? <br />r:r. Gledhill replied that it would be difficult to answer this <br />question since no Supreme.Caurt cases have been heard that litigated <br />this general area. However, he felt this agreement would not take <br />away any of the injunctive powers the County presently possesses to <br />restrict lot sales in Robins wood. sn effect, this agreement with- <br />draws the plats that are presently on record and controls the sale <br />of lots .in the newly proposed plat of the subdivision pending the <br />completion of the road system or the furnishing of a satisfactory <br />bond guaranteeing road construction. <br />Commissioner walker offered a motion to approve the Agreement <br />Regulating the Sale of Lots in the Robins Woad Development. <br />Commissioner Gustaveson seconded the motion. <br />Vote: Ayes 4; P7oes 1. The may vote was made by Commissioner <br />Whitted. The motion was declared passed. <br />A new plat of the Robins Wood Subdivision was submitted for <br />approval by the Planning Department. <br />Commissioner Walker moved that the Robins Wood Plat be approved. <br />Commissioner Pinney seconded the motion. <br />All members of the Board voted aye except A?r. Whitted who voted <br />nay. The Chairman declared the motion passed. <br />Chairman Garrett referred to Item III-D: a Resolution Adopting <br />a System for the Permanent Listing of Real Property in Orange County. <br />
