3S1 <br />intent of subsection (h) which is to prevent muncipalities from <br />using the general enabling provisions on N.C. Gen. Stat. 160A-360 <br />to amend acts of the General Assembly by municipal ordinance. <br />Chapel Hill has consistently defined its extraterritorial zoning <br />jurisdiction by metes and bounds description in local legislation. <br />The most recent metes and bounds description is contained in Chapel <br />Hill's new Charter which the General Assembly enacted in 1975. <br />(1975 Session Laws, Chapter 473). <br />Section 5.9 of the Charter includes a metes and bounds description <br />of Chapel Hill's current zoning district and includes an addi- <br />tional provision that the town may extend its zoning jurisdiction <br />to include the Southern Triangle if the Gounty Commissioners agree <br />to the extension. In Section 5.9 of the Charter, the General <br />Assembly authorized the town to exercise its extraterritorial <br />zoning jurisdiction only in the area described by metes and bounds <br />in Section 5.9 of the Charter. The General Assembly did not <br />authorize the town do use N.C. Gen. Stat. 160A-3S0 to extend its <br />zoning jurisdiction. The only expansion of Chapel Hill's <br />zoning jurisdiction authorized by the General Assembly in the <br />Charter is the inclusion of the Southern Triangle subject to the <br />approval of the Gounty Commissioners. Any other expansion of <br />Chapel Hill's zoning jurisdiction, including an expansion to the <br />North, must be authorized by the General Assembly. <br />Since Chapel Hill used local legislation to define its extra- <br />territorial zoning jurisdiction by a metes and bounds description <br />without concurrent legislative authorization to use N. C. Gen. <br />Stat. 160A-360, the Town has no authority to request an expansion <br />of its zoning jurisdiction except into the Southern Triangle." <br />Upon motion of Commissioner Whitted, seconded by Commissioner <br />Walker, .it was moved and adopted that Chapel Hill authorities be <br />notified that the County Board of Commissioners feel they have no <br />authority to comply with the request of Chapel Hill to expand its <br />zoning jurisdiction except into the Southern Triangle. <br />The County Attorney was requested to prepare such a reply to the <br />Chapel Hill request. <br />The Chairman referred to Item #10 on the Agenda: The County <br />Manager be directed to immediately begin discussion with the Town <br />of Chapel.Hill concerning a Joint Animal Shelter. The Board re- <br />quested that the County Manager report of these negotiations by the <br />first Monday of April. It is.contemplated the report should include <br />such items as site alternatives, possible cost, sharing arrangements <br />and major operational features. This report should be developed in <br />order that the Board of Commissioners might have the information <br />necessary to base a decision on the question of a joint animal pound. <br />Commissioner Whitted moved that the County Manager be so directed <br />and Commissioner Gustaveson seconded the motion. <br />Chairman Garrett called for the vote. <br />Voting aye were Commissioners Garrett; Gustaveson, and Whitted. <br />Voting nay we're Commissioners Finney and Walker. <br />The Chairman (declared the motion passed. <br />The Chairman referred to Item #13 on the Agenda: The County Manager <br />recommends acceptance of the bids of Ray Motor Company for five (5) 1976 <br />Ford Automobilies. <br />The County Manager referred the Board to the Results of the call <br />for Bids for Police Cars. The following bids were received: <br />"Bids for five police vehicles were received and opened at 10:00 a.m. <br />on February 20th.
