~ry~ <br />Upon motion of Commissioner tahitted, seconded by Commissioner <br />Gustaveson it was moved that the Board refer the question to the County <br />Attorney for a specific legal opinion with respect to a legal remedy <br />to the item. <br />Chairman Garrett called for the vote. <br />Commissioners Garrett, Gustaveson, and Whitted voted aye. <br />Commissioners Pinney and Walker voted nay. <br />The chairman declared the motion passed. <br />A. Order of Gimghaul <br />1975 Tax Refund - Chapel Hill Township, clap-B-19, Tract 6488. <br />1975 real property valuation reduced in settlement of appeal to the <br />Property Tax Commission. 1975 real property valuation was established <br />by the 1975 Board of Equalization and Review at $327,600.00. 1975 <br />valuation of personall. property - $500.00 making a total. of $328,100. <br />Tax Paid (County Tax and Chapel Hill School District Tax amounted to <br />$2,969.31.) Revised real property valuation that was approved by the <br />Board of Commissioners is $269,200. 1975 valuation of personal property <br />amounted to $500.00. Corrected Total Valuation is $269,700.00. Correct- <br />ed Total Tax (County and Chapel Hill School District, $2,44D.79. Refeunc <br />in the amount of $528.52, County Tax portion $379.60, Chapel Hi11 School <br />District Tax $148.92. Recommendations is for approval. <br />upon motion of Commissioner Pinney, seconded by Commissioner <br />Gustaveson, it was moved and adapted. that the recommendation of the <br />Tax Supervisor concerning the Order of the Gimghaul be approved and <br />that the refund of 5528.52 be made. <br />D. James and Billy Somers <br />Request for Refund of 1975 Tax. Late listing charge was applied <br />although listing was mailed and postmarked as of January 31, 1975. <br />Listing was missent by the Post Office and the form was received late <br />with two postmarks. 'T'his refund amounts to $81.31 Recommendation for <br />approval. <br />Upon motion of Commissioner Walker, seconded by Commissioner whittec <br />it was moved and adapted that the Board accept the recommendation of the <br />Tax Supervisor concerning the $81.31 request £or James and Billy Somers. <br />E. P.J.'s <br />Request for Refund of 1974 Tax. 1974 listing of business personal <br />property was included in leasehold improvements in the amount of <br />$142,849.00. P.J.'s contends this figure is (was) erroneous and includec <br />costs of renovating the building (leased) which was accounted for in the <br />building valuation and that the correct 1974 valuation of lease-held <br />improvement should be 528,000.00. 1974 total valuation $154,925; 1974 <br />total valuation (revised) $40,075.00 making total amount $114,850.00. <br />Refund of 1974 taxes 5981.97. County's portion is $689.10. Chapel Hill <br />School District Tax is $292.98. The Tax Supervisor recommends refund. <br />Discussion ensued. concerning the improvements that were added to the <br />building. The Tax Appraiser advised the Board that these improvements <br />had been added to the property card of the lessee. <br />Upon motion of Commissioner Pinney, seconded by Commissioner Whitten <br />it was moved and adapted that the Tax Appraiser re-appraise the improve- <br />ments that were made in the building. <br />'~ Action was deferred on this request until the requested report was <br />received from the Tax Appraiser. <br />F. Curious Cargo (Frank Cline, Jr.) <br />Request for Refund $94.05. The owner claims to have overstated <br />inventory on 1974 tax listing by $11,000.00 listed $42,000.00 inventory. <br />1974 County Tax is $66.00, Chapel Hi11 School District Tax $28.50. Mr. <br />Cline made a partial payment of $250.00 on '74 taxes; the December, 1975 <br />payment was used to clear the 1974 balance and make partial payment on <br />1975 tax.
