Edwards referred to Item ~6-A the Plar. of Silas Lecates: This <br />property is situated off New ~haror. Road near St. .~ary's Church. The <br />owner desires to divide one ten (10) acre tract into two five (5) <br />acre parcels. Access to a public road will be through deeded ease~.nent. <br />The Planning Board approved this plac January 19, 1976. <br />Upon motion of Commissioner Pinney, seconded by Commissioner <br />`~ihitted it was moved and adopted that the Silas Lecates plat be Approved. <br />Chsiiman Garrett stated that she felt that should there•be further <br />su'~division in the area, it would require .^:ea_^,s other than those <br />~dw being used. <br />B. Victor Zinn: This property is immediately north of the <br />Calvander Community on the east side of old Highway #86. The owr_er <br />proposes the division. of thirty-two acres into seven parcels that. <br />average arour_d four acres each. Access to the individual lots will <br />be provided by deeded easements. Road maintenance will.be required <br />of the property owners. Restrictive covenants will prevent further <br />division of the individual lots. The Planning Board approved this <br />subdividior~ on January 19, 1976. <br />Mr. Edwards advised that this was tatum soil and there was no <br />problem with the perk test. Discussion ensued concerning road access <br />and the status of private easement. <br />Upon motion of Commissioner Pinney, seconded by Commissioner <br />Gustaveson, it was moved that the Victor Zinn plat be denied due to <br />the site distance where the road intersected with old #86. <br />Chairman Garrett called for the vote. <br />Voting Aye were Commissioner Garrett, Gustaveson, Pinney snd :dalker. <br />Voting iday was Commissioner Whitted. <br />Chairman Garrett declared the :notion-passed. <br />Discussion ensued concerrir_g the use of deeded easements to evade <br />the subdivision. requirments of the Planning Ordinance. It was pointed <br />out that this was the issue involved and that deeded ease.~:ents created <br />non-roads.. <br />C. J. C. Garrett: This property is situated in E'ro Township <br />adjoining State Road #157l.~. It conszsts of five one-acre lots arranged <br />about a cul-de-sac. On July 21, 197„ the Planning Board recommended a <br />variance be granted to allow the cul-de-sac toga cor_structed at less <br />thar_ the minimum stardar.ds for state maintenance. This cul-de-sac then <br />will be a private road. <br />rlr. Edwards advised the Board that the herndor. soil ar_d perk test <br />were acceptable.
