3 <br />NORTH CAROLINA LOCALLY ADMWISTERED PROJECT -FEDERAL <br />ORANGE COUNTY <br /> DATE: 413109 <br />NORTH CAROLINA DEPARTMENT OF <br />TRANSPORTATION <br /> TIP #: C-4932 <br />AND WBS Eiements:G4932A PE 44032.'!.1 <br /> ROW 44032.2.1 <br />ORANGE COUNTY CON 44032.3.1 <br /> WBS Elements: C-49328 PE <br /> ROW <br /> CON 44032.3.2 <br /> OTHER FUNDING: <br /> CFDA #: 20.205 <br />TENS AGREEMENT is made and entered Into on the last date executed below, by and between the <br />North Carolina Department of Transports#ion, an agency of the State of North Carolina, hereinafter <br />referred to as the Department and Orange County ,hereinafter referred to as the County. <br />WITNESS ET M: <br />WHEREAS, Section 1808 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act--A <br />Legacy for Users (SAFETEA - LU), establishes CMAQ funds, which require that federal funds be <br />available-for certain specified transportation activities; and, <br />WHEREAS, the Federal Energy Independence and Security Act of 2007 allows the obligation of <br />100% Federal funding for CMAQ Projects authorized durln~ Federal Fiscal Year 2009; and, <br />WHEREAS, the County has requested federal funding for Park and Ride shelters, hereinafter <br />referred to as the Project, in Orange County, Narth Carolina; and, <br />WHEREAS, subject to the availability of federal funds. the County has been designated as a recipient <br />to receive funds allocated to the Department by the Federal Highway Administration (FHWA) for the <br />Project; and, <br />WHEREAS, the Department has agreed to administer the disbursement of said funds on behalf of <br />FHWA to the County for the Project in accordance with the Project scope of work and in accordance <br />with the provisions set out in this Agreement; and, <br />WHEREAS, the Department has programmed funding in the approved Transportation Improvement <br />Program for the Project; and, <br />Agreement iD # 149 1 <br />
