~D-S=d~' <br />y~ <br />• <br />STATE OF NORTH CAROLINA <br />THE COUNTY OF ORANGE <br />AGREEMENT FOR CONSTRUCTION <br />SERVICES <br />This Agreement made and entered into by and between the County of Orange, on behalf <br />of its Solid Waste Department, herein referred to as "County" and Tommy Lawrence <br />Electrical Construction Inc., herein referred to as "Contractor". <br />WHEREAS, the County wishes to contract with the Contractor for the installation of <br />lights at the Walnut Grove, Solid Waste Collection Center at 3605 Walnut Grove Church <br />Road, Hillsborough, NC, and <br />WHEREAS, the Contractor wishes to provide these services, <br />NOW THEREFORE, it is mutually agreed as follows: <br />1. TERM: This Agreement, unless amended as provided herein, shall be in effect <br />from the date of execution of this Agreement, until December 14, 2007. The <br />work shall be substantially complete on or before December 7, 2007 and <br />completed and ready for final payment on or before December 14, 2007. <br /> <br />2. DUTIES OF CONTRACTOR: The Contractor shall construct the lighting in <br />accordance with the attached Plans and specifications contained in ORANGE <br />COUNTY BID NO. 1516. <br />3. DUTIES OF COUNTY: The County shall pay the Contractor for completion of <br />the Work a total amount not to exceed a lump sum payment of $26,722.00 for <br />the services as set forth in the attached, plans and specifications. <br />4. BILLING AND PAYMENT: The Contractor shall submit an Application for <br />Payment on a monthly basis. The Contractor shall submit a Certificate of Final <br />Payment. <br />5. CHANGES IN THE WORK: Agreement may be amended only in writing by <br />mutual agreement of the County and Contractor. <br />6. INSURANCE PROVISIONS: The Contractor shall have the following <br />insurance coverage: <br />Worker's Compensation -Coverage to apply for all employees for <br />statutory limits in compliance with applicable state and federal laws. <br />The policy must include employer's liability with a limit of $100,000 <br />for each accident, $100,000 bodily injury by disease each employee <br />and $500,000 bodily injury by disease policy limit. <br />• <br />
