Mrs. Garrett stated that the <br />letters of appointment of rlae McLendon had to be returned and she <br />inquired of D1s. Allred as to the reason for this action. <br />Ms. Allred replied that the letters were returned due to the fact <br />that an oath of office was`not affixed to the form and •that this was <br />required by the State Commission. <br />Steve Bernholz, County Attorney, read from the General Statutes <br />and the North Carolina Constitution. <br />Discussion ensued concerning the General Statutes of North Carolina <br />as they related to the eligibility of Ms. McLendon. <br />Ms. Allred advised the Board that under the current Standards of <br />the State Social Services Commission Ms. McLendon was not eligible for <br />appointment to the local Social Services Board. However, the Standards <br />for membership are established by the State Social Services Board and <br />that if this Board agreed to change their policy relative to Section 5 <br />then Ms. McLendon could be seated. She stated that the State Social <br />Service Commission would hold its next meeting in Raleigh on Wednesday, <br />August 20, 1975, and that the Board could appear to request the State <br />~ ~ Board to reconsider Section 5. <br />Discussion ensued. <br />Chairman Garrett stated that since it had been suggested by Ms. <br />Allied, Commissioner Walker, and the County Attorney, the Board would <br />agree to appear before the State Social Services Commission on August <br />20th. Mrs. Garrett said that this will mark the first time, to her <br />knowledge, that the regulation has been challenged by a County Board <br />of Commissioners. <br />Commissioner Walker stated that he would agree to attend the <br />August 20th meeting in Raleigh. <br />Commissioner Whitted stated that he wished the County Board tp <br />request to appear on the State Social Services Board Agenda. <br />Commissioner Pinney inquired as to what exactly are the grounds <br />on which the County Board is appearing to the State Social Service <br />Board? Commissioner Whitted replied that the Board was questioning <br />Regulation #5. <br />Ms. Allred agreed to secure a ruling from the Attorney General <br />- on the question of whether or not Section 5 of the State requirements <br />are constitutional and she will share the ruling with the Board. <br />Upon motion of Commissioner Whitted, seconded by Commissioner <br />Pinney, it. was moved and adopted that the Board request to appear on <br />the Agenda of the State Social Services Commission meeting on Wednesday, <br />August 20, 1975. <br />Chairman Garrett referred to Ttem #6 on the Agenda: (A report <br />from the Chairman: Creation of a County Youth Council.) <br />David Lutz and Laura Detwiler were recognized by Chairman Garrett <br />and David Lutz reviewed the purposes and goals of the proposed Youth <br />Council. <br />
