Proceed. The Notice to Proceed shall state a commencement date on which it is expected <br />that the Contractor will begin the Work to be performed under the Agreement. The Contract <br />Time shall be measured from said specified commencement date. The commencement <br />date stated in the Notice to Proceed shall not be earlier than three (3) days after the Notice <br />to Proceed is served on the Contractor. <br />If, other than by mutual agreement, said specified commencement date is more than thirty <br />(30) days after the date of execution and delivery of the Agreement from the CM to the <br />Contractor and the Contractor believes said delay justifies an increase in Contract Price <br />and/or an extension of Contract Time, the Contractor may make a claim therefore as <br />provided in Article 14 and/or Article 15 of these General Conditions. <br />No Work shall be done prior to the date specified in the Notice to Proceed <br />The Contractor shall submit a final Contractor's Construction Schedule for approval by the <br />CM no later than fourteen (14) days after issuance of the Notice to Proceed. No payments <br />shall be due the Contractor until this schedule is approved by the CM. <br />13.4 The Master Schedule is a Contract Document. The Contractor represents that the Master <br />Schedule has been reviewed in detail and taken into account in preparing its bid. The <br />Contractor's Construction Schedule shall be incorporated into the CM's Project Master <br />Schedule. The Contractor's Construction Schedule shall include all of its activities which <br />impact, limit, or otherwise affect the time of completion of the Project as shown in the <br />Master Schedule, and all of the activities of others which impact, limit, or otherwise affect <br />the start, duration, or completion of the Contractor's activities. The Contractor further <br />represents that the Contractor can and will complete each activity within the time shown for <br />that activity. on the Contractor's Construction Schedule. Time is of the essence with respect <br />to each such activity and Completion Date. <br />13.5 If the Contractor submits a construction schedule, progress report, or any other document <br />that indicates or otherwise expresses an intention to achieve completion of the Work prior <br />to any Completion Date required by the Contract Documents or prior to expiration of the <br />Contract Time, no liability of the CM to the Contractor for any failure of the Contractor to so <br />complete the Work shall be created or implied. <br />13.6 If the Contractor, for reasons beyond the Contractor's control, is delayed in beginning any <br />activity, the Contractor shall, nevertheless, have the same number of days as is shown in <br />the Master Schedule for the activity, and the affected activity and any succeeding activity <br />that is dependent upon that activity shall be adjusted accordingly; provided that at any time <br />the CM, by means of a Change Order, may require the Contractor to work overtime, to <br />increase labor forces or to take any necessary or appropriate action to decrease the time <br />required for any activity, and the Contractor shall be entitled to an adjustment in the <br />Contract Price computed in accordance with Article 15 of these General Conditions. <br />13.7 At any time, the CM may order the Contractor, on seven (7) days written notice, to begin <br />any activity earlier than the starting date shown on the Master Schedule. <br />13.8 Should the Contractor fail to start any activity on the start date shown in the Master <br />Schedule or as it may have been adjusted in accordance with paragraphs 13.6 or 13.7 <br />above, or become delayed, the Contractor shall, without being entitled to any increase in <br />the Contract Price or other compensation, work overtime, increase labor forces or take <br />such other action as may be necessary or appropriate to complete the activity by the <br />Completion Date shown on the Master Schedule, or as such Completion Date may have <br />been adjusted. <br />GENERAL CONDITIONS FOR CM AT RISK PROJECT 27 of 43 JUNE 2007 EDITION <br />
