Sec. 4.2.38. Applicability. <br />This regulation shall apply to all SFHAs within the planning_jurisdiction of Orange <br />County and within the jurisdiction of any municipality within Orange County whose <br />~overnin~ body has duly authorized its application within its municipal or extraterritorial <br />jurisdictional, boundaries in accordance with North Carolina law <br />Sec. 4.2.39 Basis for establishing the Special Flood Hazard Area Overlay District <br />SFHA . <br />The SFHA are those identified by the FEMA or produced under the Cooperating <br />Technical State agreement between the State of North Carolina and FEMA or Flood <br />Insurance Study (FIS) and its accompanying FIRMS for Orange County dated February 2 <br />2007, with incorporation of Letters of Map Amendments 07-04-6156R 08-04-2897A <br />08-04-2898A, 08-04-2899A and 08-04-2900A Letters of Map Revision 06-04-BQ22P <br />06-04-C141P, 07-04-6156R, and 08-04-1666P and Summary of Map Amendment #115- <br />CWG (C) dated May 16 2008 which with accompan~g supporting data including <br />Letters of Map Amendment or Revision and Summary of Map Amendments are adopted <br />by reference and declared to be a part of this Ordinance. The SFHA also include those <br />defined through standard en ing Bering analysis for private developments or by <br />governmental agencies, but not incorporated into the FIlZM This includes but is not <br />limited to, detailed flood data: <br />1. Detailed flood data generated as a requirement of Section 21 11 (11/122 of this <br />Ordinance; <br />2. Preliminary FIRMs where more stringent than the effective FIRM• or <br />3. Post-disaster Flood Recovery Maps, if available. <br />Sec. 4.2.40 Compliance <br />No structure or land shall hereafter be located. extended converted altered or <br />developed, improved, or maintained in any way without full compliance with the terms of <br />this Ordinance and other applicable regulations. <br />PART VII. That Article 6 Application of Dimensional Requirements by creating a new Section <br />6.32 entitled Special Flood Hazard Area Overlay District (SFHA) to read as follows: <br />Sec. 6.32.1 Additional Requirements for the Special Flood Hazard Areas (SFHA) <br />Overlay District. <br />In all SFHAs the following_provisions are required: <br />All new construction and substantial improvements shall be anchored to prevent <br />flotation, collapse, or lateral movement of the structure. <br />
